6 -6.01 6 -7.01 <br /> D. Any police officer, building inspector, fire <br /> marshal or any properly designated agent or employee <br /> of the city shall have the unqualified right to enter, <br /> inspect and search the premises of the licensee during <br /> business hours without a warrant. If a violation <br /> exists, the appropriate action shall be taken in <br /> accordance with Minnesota Statutes, Chapter 340A.415. <br /> E. For cause, the business records of the licensee, <br /> including federal and state income tax returns, shall <br /> be available for inspection by a duly authorized <br /> representative of the city council at all reasonable <br /> times. <br /> SECTION 7. CITY COUNCIL DISCRETION <br /> 6 -7.01 Granting/ Refusing /Suspension /Fine /Revocation <br /> A. Granting or Refusing of License. All facts set out <br /> in the applications shall be investigated. Opportunity <br /> shall be given to any person to be heard for or against <br /> the granting of the license. After such investigation <br /> and hearing, the council shall grant or refuse the <br /> application in its discretion. <br /> Each license granted shall be issued to the applicant <br /> only and shall not be transferable to another holder <br /> unless in accordance with Section 6 -7.01. Each license <br /> shall be issued only for the compact and contiguous <br /> premises described in the application. No license may <br /> be transferred to another place without the approval of <br /> the City Council. <br /> B. Suspension /Fine. The city council may suspend a <br /> retail license or permit under this chapter for up to <br /> 60 days or impose a civil fine up to $2,000 for each <br /> violation after a hearing and a finding that the <br /> licensee has failed to comply with an applicable <br /> statute, regulation or ordinance relating to alcoholic <br /> beverages, following the second violation within any <br /> 12 month period. <br /> No suspension shall become effective until the licensee <br /> or permit holder has been affforded an opportunity for <br /> a hearing under Minn. Stat. Chapter 14. Notice of the <br /> time and place of the suspension hearing shall be given <br /> at least 10 days in advance and shall state the nature <br /> of the charges against the licensee. <br /> C. Revocation. The city council may revoke retail <br /> licenses after a hearing finding that the licensee has <br /> had three offenses during a 12 month period or has <br /> willfully violated an applicable statute, regulation or <br /> ordinance relating to alcoholic beverages which, under <br /> state law, requires mandatory revocation. <br /> 8 <br />
