8 -4.01 8 -4.03 <br /> B. Dutch Elm Disease and Similar Pest Programs. It <br /> is the intention of the council to conduct a <br /> shade tree program pursuant to the authority <br /> granted by Minnesota Statute, Section 18.023, <br /> including amendments to said statute made from <br /> time to time. Sections 1505.0010 1505.0380 of <br /> Minnesota Department of Agriculture Regulations <br /> (Chapter 1505, Pest and Disease Control) together <br /> with amendments, are hereby adopted by reference <br /> and made a part of this section as if set out in <br /> full. A copy of the department's rules as <br /> incorporated is on file in the clerk's office. <br /> 8 -4.02 Applicability. <br /> This ordinance provides full power and authority <br /> over all trees, plants and shrubs located within <br /> street rights -of -way, parks and public places within <br /> the city; and to trees, plants and shrubs located <br /> on private property that constitute a hazard as <br /> described herein. <br /> 8 -4.03 City Forester. <br /> A. Appointment. <br /> 1. The council shall appoint the forester for a <br /> term of one year, to begin with the first <br /> meeting of the council each January. <br /> 2. If the forester position is vacant, the <br /> administrator shall arrange for a qualified <br /> person to serve as acting forester. <br /> B. Authority and Duties. <br /> 1. The forester shall have jurisdiction and <br /> supervision over all trees, shrubs, and <br /> other plants growing within the city. <br /> 2. The forester may order the trimming, <br /> treatment or removal of any trees or plants <br /> on public or private property that <br /> constitute a nuisance or hazard, or <br /> whenever necessary to prevent the spread <br /> of disease or harmful insects. <br /> 9 <br /> 111 <br />
