4 -5.01 to 4 -5.04 <br /> SECTION 5. FRANCHISES <br /> 4 -5.01 Non- Exclusive Gas Franchise. The City Council has <br /> granted to Northern States Power Company, a Minnesota <br /> corporation, "NSP its successors and assigns, a non- <br /> exclusive gas franchise. Thereby, NSP, its successors and <br /> assigns, shall construct, operate, repair, and and maintain <br /> in the City a system of mains, pipe lines, and other <br /> facilities for the manufacture, distribution, and sale of <br /> gas, subject to certain terms and conditions set forth in <br /> the NSP Nonexclusive Gas Franchise Agreement on file in the <br /> city office. <br /> 4 -5.02 Non Exclusive Electric Franchise. The city council <br /> hereby has granted to Northern States Power Company, a <br /> Minnesota Corporation "NSP its successors and <br /> assigns a non exclusive electrical franchise. Thereby, <br /> NSP, its successors and assigns, shall in furnishing <br /> electrical energy to the city, its inhabitants, and <br /> others, construct, operate, repair, and maintain in the <br /> city an electric distribution system and transmission <br /> lines including the necessary poles, pole lines, <br /> fixtures and appurtenances and use the city's streets, <br /> alleys, public ways and public grounds for such purposes <br /> subject to certain terms and conditions set forth in the <br /> NSP Non Exclusive Electrical Franchise Agreement on file <br /> in the city office. <br /> A. Fees. The city council may by resolution establish, <br /> change and amend a surcharge fee based on electrical <br /> consumption as provided in the Northern States Power <br /> Franchise Agreement. <br /> 4 -5.04 Non Exclusive Cable Communications Franchise. <br /> City Council has granted to Group W Cable of the North <br /> Suburbs, Inc., a Minnesota corporation, "Group W its <br /> successors and assigns a non exclusive cable <br /> communications franchise. The Grantee, its successors <br /> and assigns, shall in furnishing cable communication to <br /> the city, its inhabitants and others, construct, <br /> operate, repair and maintain in the city a cable <br /> communications system including necessary poles, pole <br /> lines, fixtures and appurtenances and use the city's <br /> streets, alleys, public ways and public grounds for such <br /> purposes subject to certain terms and conditions set <br /> forth in the Group W. Non exclusive Cable Communications <br /> Franchise Agreement on file in the office of the city <br /> clerk. <br /> 7 <br />
