5 -1.03 <br /> 5. Exemptions. Itinerant salespersons acting on <br /> behalf of any religious association or any non- <br /> profit corporation registered with the state of <br /> Minnesota shall not be subject to this section <br /> provided the proceeds of any sales are being used <br /> for such charitable, religious or philanthropic <br /> purposes. However, upon providing proper proof of <br /> exemption, the city clerk shall issue a <br /> certificate to the organization listing the names <br /> and addresses of all salespersons acting on behalf <br /> of the organization. A copy of this certificate <br /> shall be carried by the salesperson or be in <br /> his /her vehicle at all times. <br /> D. Tobacco Related Products <br /> 1. License Required. No person shall keep for <br /> retail sale, sell at retail or otherwise dispose <br /> of any tobacco product as defined in this <br /> ordinance at any place in the city without a <br /> license. Application for a license should be made <br /> to the city clerk on a form supplied by the city. <br /> Upon filing of the application and payment of the <br /> required fee as stipulated in Section 5 -5.01 of <br /> this code, the application shall be presented to <br /> the city council for consideration. <br /> 2. Definitions. <br /> a. "Tobacco related product" means <br /> cigarettes, cigars, cheroots, stogies, <br /> perique, granulated, plug cut, crimp cut, <br /> ready, rubbed and other smoking tobacco; <br /> snuff, snuff flower, cavendish, plug and <br /> twist tobacco, fine cut and other chewing <br /> tobaccos; shorts, refuse scrips, clippings, <br /> cuttings, and sweepings of tobacco prepared <br /> in such manner as to be suitable for chewing, <br /> sniffing or smoking in a pipe, rolling paper <br /> or other tobacco related devices. <br /> b. "Self service merchandising" means open <br /> display of tobacco products that the public <br /> has access to without the intervention of an <br /> employee. <br /> c. "Individually packaged" means any package <br /> containing only one individually wrapped <br /> item. Included are single packs of <br /> cigarettes, single bags of tobacco for <br /> 4 <br />
