No. 0 -94 -05 <br /> CITY OF FALCON HEIGHTS <br /> O R D I N A N C E <br /> Date 3 -23 -94 <br /> AN ORDINANCE AMENDING CERTAIN SECTIONS OF CHAPTER 9 <br /> OF THE CITY CODE RELATING TO ZONING <br /> THE CITY COUNCIL OF THE CITY OF FALCON HEIGHTS HEREBY ORDAINS AS <br /> FOLLOWS: <br /> 1. Chapter 9 §9 -1.02, Subd. 2 Definitions is amended to add the <br /> following definitions: <br /> Adult Uses. Defined but not allowed in any district. <br /> Includes the following: <br /> a) Adults -only bookstore: An establishment having <br /> as a substantial or significant portion of its <br /> stock in trade, books, magazines, films for sale <br /> or viewing on premises by use of motion picture <br /> devices or other coin operated means, and other <br /> periodicals which are distinguished or <br /> characterized by their principal emphasis on <br /> matters depicting, describing or relating to <br /> nudity, sexual conduct, sexual excitement or <br /> sadomasochistic abuse, as defined below, or an <br /> establishment with a segment or section devoted to <br /> the sale or display of such material, for sale to <br /> patrons therein. <br /> b) Adults -only motion picture theater: An <br /> enclosed building used regularly and routinely for <br /> presenting programs, material distinguished or <br /> characterized by an emphasis on matter depicting, <br /> describing or relating to nudity, sexual conduct, <br /> sexual excitement or sadomasochistic abuse, as <br /> defined below, for observation by patrons therein. <br /> c) Massage parlor: An establishment or place <br /> primarily in the business of providing massage <br /> services but not a therapeutic massage enterprise <br /> as defined in this code. <br /> d) Rap parlor: An establishment or place <br /> primarily in the business of providing <br /> nonprofessional conversation or similar services <br /> for adults. <br /> e) Sauna: An establishment or place primarily in <br /> the business of providing (i) a steam bath and <br /> (ii) massage services. <br /> 1 <br />
