1. Fines for salespersons. A graduated fine for a salesperson selling <br /> tobacco products to a minor with the first fine at 25 and the next fine <br /> at 100. More than two violations in a 12 month period will result in <br /> charging the individual with a misdemeanor. <br /> 2. Increasing penalties for vendors. The proposed amendment proposes a <br /> four step penalty procedure for store owners (vendors) over a twelve <br /> month period. <br /> Note: All license suspensions require a hearing before the City Council. <br /> 1st violation a 200 fine to store owner; failure to <br /> pay within sixty days can result in a <br /> two day license suspension <br /> 2nd violation in 12 months a 500 fine to store owner; failure to <br /> pay within sixty days can result in a <br /> two day license suspension <br /> 3rd violation in 12 months a five day suspension of tobacco <br /> license <br /> 4th violation in 12 months revocation of the tobacco license for <br /> one year <br /> 3. Fees. Increase from $40 to $250. Staff recommends increasing the <br /> tobacco licensing fee from 40 a year to 250 a year to cover the cost <br /> of a minimum of three compliance checks a year and processing time. <br /> (Ideally, four compliance checks will be done a year.
