Meeting Date 8/ 24/ 94 <br /> Agenda Item: P 3 <br /> CITY OF FALCON HEIGHTS <br /> REQUEST FOR COUNCIL CONSIDERATION <br /> ITEM DESCRIPTION: Discussion of the itinerant salespersons and solicitors <br /> license <br /> REQUESTED BY: John Hustad, Councilmember <br /> REVIEWED BY: Susan Hoyt, City Administrator <br /> EXPLANATION /SUMMARY: prepared by Susan Hoyt <br /> Councilmember Hustad wishes to review the city's itinerant salespersons and <br /> solicitors license. <br /> Background <br /> For profit salespersons. The city regulates for profit salespersons by requiring <br /> a license and by requiring them to adhere to hours of operation between 9 AM <br /> and 7 PM and not on Sundays except by specific appointment. A fee of 35 <br /> is charged for the license. <br /> If a property is posted "no solicitors" or something similar, the salesperson <br /> cannot go onto the property. <br /> Non profit salespersons or solicitors. The city regulates non profit solicitors by <br /> requiring a license. There is no fee attached and they are exempted from the <br /> hours of operation. <br /> Clarifications. The code should be clarified by defining the term solicitor which <br /> would remove some of the current language's ambiguity. <br /> Constitutional requirement. The state constitution guarantees sellers of farm <br /> and garden produce that is grown by the seller to peddle without a license. <br /> Brief synopsis of some nearby cities' requirements. <br /> Roseville. No regulation addresses non profit soliciting. However, for profit <br /> itinerant salespersons or solicitors that "practice going in or upon private <br /> residences" are declared a nuisance in the city code and violators are subject <br /> to a misdemeanor. <br /> New Brighton. Requires a license for those soliciting for civic, patriotic, <br /> charitable or religious non profits on "city streets The permit cannot exceed <br /> 30 consecutive days in one calendar year and only one permit is issued per <br /> organization per year. Requires a license for for profit salespersons. <br /> Shoreview. Similar to Falcon Heights. <br /> ACTION REQUESTED: <br /> Discussion. <br />
