5 -1.03 <br /> C. Itinerant Salespersons and Solicitors. <br /> 1. Definition. The term "itinerant" salesperson <br /> means any person who sells or attempts to sell any <br /> goods where the solicitation or sale does not occur <br /> within a building, store or structure owned <br /> or leased by a business and properly zoned for <br /> commercial use. The term shall not include persons <br /> delivering goods sold upon commercial premises <br /> prior to the delivery, or persons distributing <br /> their products to regular customers on established <br /> routes, such as vendors of milk, groceries or <br /> newspapers. <br /> 2. License Required. Every itinerant salesperson <br /> must apply to the city clerk for license. Upon <br /> approval by council and issuance of the license, <br /> the license must be carried by the salesperson or <br /> be in his /her vehicle at all times. If a business <br /> employs more than one itinerant salesperson, a <br /> separate license is required for each salesperson. <br /> The license fee is as stipulated in Section 5 -5.01 <br /> of this code and will not be prorated. <br /> 3. Hours of Operation. It shall be unlawful for <br /> itinerant salespersons and solicitors to engage in <br /> the business of peddling within the city between <br /> the hours of 7:00 P.M. and 9:00 A.M. the following <br /> morning, or at any time on Sundays, except by <br /> specific appointment with or invitation from the <br /> prospective customer. <br /> 4. Entrance to Premises Restricted. It shall be <br /> unlawful for itinerant salespersons and solicitors <br /> to enter upon any private premises when such <br /> premises are posted with a sign stating "No <br /> Peddlers Allowed" or "No Solicitation Allowed" or <br /> other words to such effect. <br /> 5. Exemptions. Itinerant salespersons acting on <br /> behalf of any religious association or any non- <br /> profit corporation registered with the state of <br /> Minnesota shall not be subject to this section <br /> provided the proceeds of any sales are being used <br /> for such charitable, religious or philanthropic <br /> purposes. However, upon providing proper proof of <br /> exemption, the city clerk shall issue a certificate <br /> to the organization listing the names and addresses <br /> of all salespersons acting on behalf of the <br /> organization. A copy of this certificate shall be <br /> carried by the salesperson or be in his /her vehicle <br /> at all times. <br /> 3 <br />
