MINUTES CITY COUNCIL May 28, 2008 LLC AS PRESENTED BY THE CITYADMINISTRATOR AND AUTHORIZING THE CITYADMINISTRATOR'S EXECUTION OF THE AGREEMENT ON BEHALF OF THE CITY The foregoing resolution was duly seconded by Keis. Ayes (5). Nays (0). Resolution declared adopted. OFF-SALE The City Clerk reported that State Statute has been revised allowing LIQUOR Off-Sale Liquor stores to remain open until 10 p.m. on Mondays through STORE Thursdays. The City Code continues to require these stores to close at HOURS 8 p.m, on Mondays through Thursdays. Liquor stores can remain open until ] 0 p.m. on Fridays and Saturdays. The Clerk reported that Tierney's Liquors has requested that the City amend its code to coincide with State Statute. She further reported that she has checked with surrounding cities and all have amended their codes to allow the later hours. The Clerk noted that State Law continues to require that Off-Sale Liquor stores close at 8 p.m. on Christmas Eve. Staff recommended approval of the ordinance amendment as requested by Tierney's Liquor. Mr. Blesener introduced the following resolution and moved its adoption: RESOLUTION NO. 2008-5-142 - APPROVING AN ORDINANCE AMENDMENT TO CHAPTER 703 OF THE MUNICIPAL CODE ALLOWING OFF-SALE LIQUOR STORES TO REMAIN OPEN UNTIL 10 P.M. ON MONDAYS THROUGH THURSDAYS AS ALLOWED BYSTATE LAW WITH THE CLOSING TIME OF 8 P.M. TO REMAIN FOR CHRISTMAS EVE The foregoing resolution was duly seconded by McGraw. Ayes (5). Nays (0). Resolution declared adopted. TEMPORARILY The City Attorney indicated that at this point in the meeting, 9:55 p.m., ADJOURN the Council will temporarily adjourn into closed session to discuss INTO pending litigation, Little Canada versus Vadnais Heights. CLOSED SESSION Montour introduced the following resolution and moved its adoption: RESOLUTION NO. 2008-5-143 - TEMPORARILYADJOURNING INTO CLOSED SESSION TO DISCUSS PENDING LITIGATION, 20
