MINUTES <br />CITY COUNCIL <br />May 28, 2008 <br />classified as fire lanes, therefore, would not have to meet fire codes. <br />McGraw suggested that perhaps the Deputy Fire Marshal should review <br />the I-1 site plans as they are submitted to determine where fire lanes are <br />necessary. <br />The Planner also indicated that the Fire Department likely would not drive <br />right up to a fire, but would set up a distance away and drag hoses to fight <br />a fire. <br />McGraw suggested that the Council does not have control over this issue, <br />that the Fire Code would control. Montour stated that he would argue that <br />the Council has control as not all drive aisles are fire lanes. <br />1"he City Administrator suggested that staff meet to define fire lane versus <br />drive aisle, and suggested that one solution may be for the Deputy Fire <br />Marshal to review these site plans to determine when fire lanes are <br />necessary. The City Attorney agreed that the Fire Department or Deputy <br />Fire Marshal should comment on these plans. The Administrator <br />indicated that he would bring a recommendation back to the Council. <br />EDGERTON The City Administrator reported that the City just received the results <br />SPEED of the Edgerton Street speed study that was requested in 2006. Based <br />STUDY on the results of that study, MN DOT has determined that the speed on <br />Edgerton Sriā€¢eet within Little Canada city limits will remain at 40 miles per <br />hour. <br />Montour expressed concern that the speed within Little Canada is to <br />remain at 40 mph when it is 30 mph in Maplewood and 35 mph in <br />Vadnais Heights. The Administrator stated that it is his understanding that <br />MN DOT factors in the actual speeds traffic is driving in determining their <br />recommendation. <br />BIAGINI The City Administrator presented a Subordination Agreement between <br />SUBORDINATION the City and RAB, LLC. The Administrator reported that Mr. Biagini <br />AGREEMENT has refinanced the Phase II property, and the mortgage lender requested a <br />new Subordination Agreement. The Administrator noted that the key <br />provision in this agreement is that the City's right of reverter is <br />subordinate to the developer's first mortgage on the property.
