MINUTES
PLANNING CODIIVIISSION
JANUARY 13, 2004
The City Planner reported that the proposal meets the criteria of the
Zoning Code amendment just acted upon.
Dura~y recommended approval of a Conditional Use Permit allowing
motor vehicle and recreation equipment sales (indoor) and garages
accessory thereto for 3173-3177 Spruce Street as requested by Ric]< Igo
subject to compliance with the recommendations of the City Planner.
Motion seconded by Weilre.
Motion carried 6 - 0.
SUBDLViS1ON The City Planner reviewed a proposed amendment to the Subdivision
ORDINANCE- Ordinance which establishes pipeline setback requirements for new
PIPELINE subdivisions. "phe Planner noted Chat the City currently has a Pipeline
SETBACKS Setback Policy, but indicated that enacting an ordinance will provide the
City greater enforcement ability. The Plamier also noted that this
provision is proposed as past of the Subdivision Code relative to new plats
rather than theLoning Code so as to not create non-conformities for
existing development.
Knudsen noted that the proposed amendment establishes the setback from
the edge of the pipeline easement rather than the pipeline itself. Knudsen
asked if this was because in some situations it is difficult to know the
exact location of the pipeline. 'The Planner indicated that that is correct.
i<nudsen asked about the construction of public streets with relation to
pipeline easements. The City Planter noted that the City Code requires
that streets and street rights-of=way be outside pipeline easements.
In reviewing the proposed amendment, the Planner suggested that the last
sentence of the f rst section be amended to read: "Any lot subject to such
an easement shall contain a buildable area of no less than sixty (60) feet of
width and sixty (60) feet of depth outside the setback established by this
section."
Duray asked the impact on the pipeline setback policy if this ordinance is
adopted. The Planner indicated that the policy would still be in effect and
would be used as a guideline when dealing with development that would
not require platting.
Wojcik recommended approval of au ordinance amending Chapters
1003.010 and 1006.020 of the Little Canada City Code, lo~own as the
Subdivision Ordinance, by providing for restrictions on the subdivision of
new lots located near petroleum pipelines as amended by the City Planner.
_ ,~ _
