MINUTES <br />PLANNING COMMISSION <br />JULY 14, 2005 <br />with large tracts of property who built houses relying on the 5 yard <br />setback would not be penalized by the change. <br />Knudsen noted the 2.97 foot garage setback on the south property line. <br />The City Planner indicated that this is an existing condition noting that the <br />new property line is being created along the north side of the house. <br />Socha commented that the existing garage would be grandfathered in, but <br />any construction that occurs on the newly created lot would have to adhere <br />to all City Code requirements. The Planner indicated that that is correct. <br />Barraclough reported that he contacted Cliff Aichinger at the Watershed <br />relative to the wetland issue raised in the City Planner's report. Aichinger <br />indicated that the back approximately 1/3 of the lot is wetland area, and <br />the lot is developable as long as the house does not encroach into the <br />wetland and there is no filling in the wetland. Barraclough indicated that <br />the lot is 208 feet deep and there is room to build a house on the lot <br />without encroaching into the wetland area. <br />The City Planner indicated that his concern was that the wetland did not <br />encroach into the buildable area of the lot, and it appears that it does noC. <br />The Planner agreed that given the depth of the lot there will be adequate <br />room to construct a house. <br />Rheaume asked if the new house would be lined up with the houses on <br />either side. Barraclough anticipated that the established front yard setback <br />would be maintained. The Planner noted that the house at 2545 Edgerton <br />Street has a 49 foot front yard setback. Knudsen stated that his suspicion <br />would be that the new house would be set closer to the street. The <br />minimum front yard setback is 30 feet. <br />Duray stated that he lives across the street from this property and the <br />property is heavily wooded in the back. Duray felt that a new house <br />would complement the neighborhood. <br />Rheaume asked about the park charge. The City Planner indicated that <br />new home construction is subject to a park charge which would be <br />collected at Che time a building permit is issued for the new lot. <br />Barraclough asked if a wetland delineation is necessary. The City Planner <br />indicated that as long as Che Watershed is comfortable that the property <br />can be developed without encroachments into the wetland, that would be <br />satisfactory. <br />Duray recommended approval of the subdivision of 2545 Edgerton Street <br />into two single-family lots as requested by Carol Berglund subject to <br />-2- <br />
