MINUTES
PLANNING COMMISSION
SEPTEMBER 8, 2005
fishing and skiing. He also noted that Joe's has received a Community
Pride Award for the appearance of their property.
Knudsen stated that he supported the outdoor display of these items as
long as it was done in a limited fashion as recommended by the City
Planner. Knudsen stated that his only concern was the precedent that this
would set for other B-3 properties in the City.
Duray asked if B-3 properties are allowed outdoor storage. The Planner
replied that they are not.
The Planner noted his recommendation that an Interim Use Permit should
be utilized for allowing outdoor seasonal displays in the B-3 District. A
termination date would be established under an Interim Use Permit, which
gives the City more enforcemenC authority if a property owner is abusing
the situation.
Knudsen asked if #2 in the Planner's report should be more restrictive.
The City Planner indicated that the intent of this restriction is that the
merchandise being displayed does not include advertising such as store
name or price. Rauscher indicated that the trampoline they had displayed
did include the brand name.
The Planner indicated that if the merchandise displayed includes a
message that is not readable from the street, then for purposes of the sign
ordinance, that message would not be considered a sign.
Knudsen noted thaC Joe's location does not have adjacenC residential
properties to be concerned with.
Hall noted that the Code's definition of a sign does not include any
qualifiers about size or visibility. The Planner indicated that it is his
interpretation that when a message is noC visible to the general public
driving buy, it is not considered a sign.
Hall. asked if an amendment to the Code is needed to establish an interim
permit in the B-3 District. The Planner reported that it would.
Hall asked if Joe's has plans to do more outdoor displays than it has
already done. Rauscher replied that they would like to display the water
hampoline on both sides of the building. They would also like to have
more tri-pod hunting stands and canoe and kayak display racks. Rauscher
noted the display locations shown on their site plan.
Barraclough asked about the 5% display area limitation proposed by the
City Planner. The Planner indicated that the 5% would be of all usable
-2-
