MINUTES <br />CITY COUNCIL <br />JULY 13, 2005 <br />Blesener reported that Little Canada does not want to be known as a cell <br />tower City. Weiss indicated that they can submit the engineering data for <br />third party review. <br />Montour reported that he would like an inventory of current tower sites in <br />Little Canada regardless of who owns them. Weiss reported that she <br />submitted such a map to City staff. City staff disagreed and indicated no <br />such map was received. Weiss submitted a map to the Council, and then <br />discovered it was a map of the Hugo area. Weiss indicated that she would <br />submit the appropriate map to City staff. <br />Blesener asked how long a third party review would take. Weiss indicated <br />that she felt Cingular has followed the City's submission process to the <br />"T". Blesener disagreed and indicated that Cingular has not proves that a <br />co-location is not possible. Weiss stated that City staff has accepted the <br />information submitted and has recommended approval of the CUP. The <br />City Administrator noted his memo dated July 8, 2005 and disagreed that <br />this memo recommends approval of the CUP. The Administrator pointed <br />out Yhat when Che City Planner did his iniCial review on the CUP <br />application, he notes that if the City determines Chat the proposed use <br />cannot be reasonable accommodated by requiring co-location, then his <br />office would recommend approval. The Administrator felt that a third <br />party review would be necessary to make this determination. The <br />Administrator also pointed out the during the application process the City <br />received a call from a third party representing Cingular that indicated the <br />need to renegotiate the City's water tower lease with Cingular. As a <br />result, the City is increasing its scrutiny of the need for Che new tower to <br />ensure it is not an attempt by Cingular to eliminate its water tower <br />antenna. <br />Weiss felt that the Cwo issues were separ•aCe. The CUP for a new tower is <br />being request to enhance service to the 694/Rice Street area. The lease for <br />antennas on the water tower has been in effect since 1989 and is not <br />expired. That lease is in full force and could extend through 2019. The <br />City Administrator pointed out that the lease could be cancelled in 2008. <br />Weiss explained that the lease was enacted in 1989 at a lease rate of $600 <br />per month. On each 5 year anniversary the lease rate is increased by the <br />CPI, and the current rate is $1,833. Weiss read the termination language <br />contained in the lease. Weiss again indicated that the proposed tower at <br />3250 Spruce Street would not replace the antenna on the water tower. The <br />proposed tower would serve the 694/Rice Street area. <br />The City Administrator has if Mark Holm, who initially represented <br />American Tower in their CUP request, was a certified RF engineer.
