MINUTIrS <br />CITY COUNCIL <br />JULY 13, 2005 <br />stated that she did not know Holm's credentials, but thought that he was <br />an attorney-at-law. <br />The City Administrator indicated that it is the City's obligation to ensure <br />that an additional cellular tower is needed before approving a request. The <br />Administrator stated that he has not seen the data that would support <br />Cingular's claim that the additional tower is needed and Chat a co-location <br />is not possible. <br />Weiss indicated that she could supply this information, but asked if the <br />City was still going to tie the two issues together. <br />The City Administrator noted that Cingular brought the water tower lease <br />issue into the picture as a result of a call to City staff indicating the need to <br />negotiate down the lease rate. The Administrator indicated that given <br />Cingular's request to build an additional communications tower, and the <br />call relative to the water tower lease, the connection between these two <br />issues has come into question. The Administrator requested that Weiss <br />provide Cingular's engineering data so that the City can have a third party <br />review the data relative to the issues of co-location, relocation of the <br />existing antenna on the Donovan Tower, and co-location height and <br />engineering on the Donovan Tower versus a new tower. <br />Keis stated that he would also like a map showing all the cell towers that <br />are located in Little Canada. <br />Allan asked about improvements in technology which would allow more <br />capacity from the City's water tower. Weiss indicated that given the <br />amount of traffic on 35E and customer demand, the water tower antennas <br />cannot handle more capacity than they already do. <br />Weiss presented to the Council language that could be added to the CUP <br />permit which indicates that Cingular states that the 3250 Spruce Street <br />tower will not replace the coverage objective of the water tower lease site. <br />That language indicated that if the lease is terminated for Che sole purpose <br />to transfer the coverage objective to the new site at 3250 Spruce Street, the <br />CUP would be in violation of the Code and the tower would be removed <br />within 120 days. <br />The City Administrator questioned the language "sole purpose" as stated <br />above. <br />Blesener noted that Cingular has waived action on the CUP until the July <br />2Th City Council meeting; therefore, the Council can table the matter <br />pending additional information. <br />
