MINUTES <br />CITY COUNCIL <br />SEPTEMBER 28, 2005 <br />size, type, and location of trees. The City Planner suggested that the Watershed District <br />can assist in this, noting that the City did not design a landscape plan for the developer. <br />The Planner suggested that Dayspring's landscape architect put together a plan for the <br />City's review. <br />Von Riedel asked if this recommendation is an ordinance requirement. The City Planner <br />indicated that this is part of the original requirements for the Preliminary Plat that <br />required landscaping along the wetland edge. There is no landscaping shown in that area <br />as part of the Final Plat submittals. Rather than City staff designing the plan, the City <br />Planner indicated that this recommendation gives Dayspring some guidelines as to the <br />number of trees. The Planner also noted that there are Zoning Ordinance minimums for <br />the size of over-story trees. <br />Von Riedel felt that the recommendation was going beyond the City's ordinance. The <br />City Planner pointed out that the ordinance says that where landscaping is required, that <br />landscaping needs to meet the City's ordinance requirements. <br />Von Riedel stated that he will have to review this recommendation as well as the City's <br />ordinance in more detail, and see what can be done to add more material along the <br />wetland edge. <br />The City Administrator asked if Dayspring is willing to add the additional 60 to 70 trees <br />Von Riedel reported that he will have to look at this in more detail for more definition. <br />He noted that materials along the wetland edge could be shrubs versus trees. <br />The City Administrator noted that this is a requirement of the Preliminary Plat that was <br />agreed to by Dayspring. The plans submitted as part of this Final Plat do not show <br />compliance with the Preliminary Plat recommendation. <br />Von Riedel indicated that he is willing to work to resolve this issue <br />The three outlots are owned in equal, undivided interests by each of the lot owners in the <br />plat, rather than by a Homeowner's Association, and Covenants are changed to reflect <br />this ownership. <br />Von Riedel indicated acceptance of this recommendation. <br />Trail easement documents are executed to provide pedestrian access from Preserve Court <br />to and across the wetland area, including trail easement along the west plat boundary to <br />the wetland, over the wetland, and reconnecting to Preserve Court at the cul-de-sac. <br />Blesener noted that Von Riedel indicated acceptance of this recommendation when made <br />by the Parks & Recreation Commission in November of 2002. Von Riedel stated that his <br />position was that compliance with this recommendation should be credited against the <br />City's park dedication fee. The City Administrator indicated that the City would work <br />with Von Riedel to resolve this issue. <br />11 <br />
