MINUTES <br />CITY COUNCIL <br />SEPTEMBER 28, 2005 <br />recommendation is asking thaC he obtain an easement on property that he does not own. <br />The City Engineer reported that if there is an existing drainage and utility easemenC on <br />the property to the south, this would address his concern. The City Engineer <br />recommended that Von Riedel determine whether or not the easement exists. <br />Von Riedel indicated that he will determine this information, and will work with the City <br />on this issue. <br />9. The City Building Inspector noted that in accordance with Minnesota State Building <br />Code 1303.1600 the minimum soil frost protection is 3.5-feet for building sites. The <br />protection must extend laterally as well as horizontally. Therefore, retaining walls must <br />be at least 42-inches away from the foundation of any home to provide for this protection <br />unless a licensed Engineer provides a signed plan detailing an alternative. It appears that <br />some walls are within the minimum 42-inches. The walls must be revised or signed <br />drawings provided prior to final grading plan approval. <br />Von Riedel indicated acceptance of this recommendation. <br />10. The Developer should review the ground floor and lowest floor shown for the building <br />pad on Lot 4. As currently shown, Che driveway would be aC 11.8%o and retaining walls <br />are necessary on three sides to support the lot due to the high elevations. <br />Von Riedel indicated acceptance of this recommendation. <br />Utility Plan <br />1. The storm structures on Preserve Trail should be moved back to the radius point and an <br />additional structure added at the radius point of Preserve Court to move the storm line <br />under the curb and away from the retaining wall to the east of Preserve Trail. <br />Kevin Gardener indicated that his concern was to comply with this recommendation may <br />not gain much separation between the storm sewer line and the retaining wall. He is not <br />sure the recommendation is necessary as long as a catch basin is added at the radius <br />points. The City Engineer replied that compliance with Che recommendation may not get <br />a huge distance separation, but felt that any additional separation would be beneficial. <br />The recommendation will add the cost of one structure. The City Engineer noted that the <br />developer previously agreed to treat the storm water from Preserve Court in the westerly <br />pond. <br />Von Riedel indicated that if the City Engineer feels this was the best solution, then it was <br />acceptable to him. Von Riedel indicated that he did not oppose the addition of one more <br />storm sewer structure. The City Engineer indicated that he would look aC the elevation in <br />more detail as far as catch basin locations are concerned. However, his recommendation <br />remained for one additional storm sewer structure. <br />16 <br />
