MINUTES <br />CITY COUNCIL <br />SEPTEMBER 28, 2005 <br />USE Joe's Sporting Goods outdoor seasonal displays of recreational <br />PERMIT - equipment at their site aC 33 East County Road B. It was noted that <br />JOE'S the City Planner and the Planning Commission recommended approval <br />SPORTING subject to the conditions outlined in the City Planner's reporC and <br />GOODS subject to the Interim Use Permit extending through December 31, 2007. <br />Joe Rauscher, Joe's Sporting Goods, informed the Council that they would <br />like to have outdoor display of some large seasonal recreational equipment <br />on both the County Road B side of their building as well as Che Highway <br />36 side. Rauscher pointed out the seasonal displays would consist of such <br />items as 16-foot tall deer stands in the fall and water trampolines, canoes, <br />and kayaks in the spring and summer. Rauscher reported that the <br />recreational equipment his business sells covers four seasons, however, <br />displays would not occur at this time during the winter months. The <br />winter season generally covers ice houses which would be displayed <br />inside the store. <br />The Council commented on the kayak that was displayed on top of the <br />store as well as the trampoline on the side of the building. Rauscher noted <br />that he displayed these items and then found out the Code did not allow <br />these outdoor displays. Therefore, he is asking for the proposed Text <br />Amendment. Rauscher stated that he felC the kayak was an interesting <br />display on top of the building. He noted that it is necessary to display Che <br />trampoline upright on the side of the building so that children could not <br />jump on it and get hurt. Rauscher noted the diagram he submitted <br />showing where the outdoor displays would occur. It would be his <br />intention to continue to display the trampoline on Che side of the building. <br />There was no one from the general public present wishing Co comment on <br />this matter. <br />Allan expressed concern with the interim use permit extending through <br />December 31, 2007. She suggested a one year permit initially. If there <br />are no problems, Allan indicated that she would support a two year permit <br />after that. <br />Blesener indicated that he liked the interim permit option rather than a <br />conditional use permit which runs with the land. Blesener stated that he <br />did noC have a concern with the initial two year permit, and felt it would <br />give Joe's an adequate amount of time to determine if Chis proposal works <br />for their business. Blesener also noted that the maximum amount of <br />display area would be limited to 5% of the building size. <br />Montour asked how this Text Amendment would impact other B-3 <br />properties in the City. The City Planner noted that the City has a limited <br />amount of B-3 zoning, and pointed out that a good share of the retail <br />
