MINUTES <br />CITY COUNCIL <br />SEPTEMBER 28, 2005 <br />difficult decision to make, and pointed out the Council must abide by its <br />codes. <br />Blesener pointed out that the Council is limited to enforcing the City's <br />codes, and this proposed Final Plat meets those codes subject to <br />compliance with the recommendations of City consultant and staff. <br />Mr. Blesener introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2005-9-225 -APPROVING THE FINAL PLAT <br />FOR DAYSPRING PRESERVE CONSISTING OF FOURTEEN (l4) <br />SINGLE FAMILY LOTS SUBJECT TO COMPLIANCE WITH THE <br />FOLLOWING: <br />WHEREAS a preliminary plat was approved for The Preserve on October 23, 2002 subject to <br />numerous conditions. and <br />WHEREAS, the developer of The Preserve has stipulated agreement to all of the conditions of <br />the preliminary plat approval except for the following: <br />1. Moving Preserve CourC off of William's Pipe]ine Easement <br />2. Centering of Preserve Trail on the lot that it is proposed to be located within <br />3. Compliance with Little Canada's Pipeline Setback Policy <br />4. Combining the two lots at the east end of the property (formerly Lots 1 & 2, of Block <br />2) into one lot to provide proper lot width requirements and additional spacing from <br />the pipeline, and <br />WHEREAS, after denial of a proposed final plat on August 28, 2002, the developer has now <br />submitted a revised final plat, and <br />WHEREAS, the proposed final plat and related documents submitted on September 15, 2005 <br />more closely resembles the intent of preliminary plat approval, and <br />WHEREAS, developer has now proposed locating Preserve Court off of the pipeline easement, <br />has effectively centered Preserve Trail between existing properties, and has combined the two <br />lots proposed at the easC end of the development into one loC (Lot 14, Block 1), and <br />WHEREAS, staff has completed their review of developer's final plat submittals, and <br />WHEREAS, staff has recommended approval of the final plat subject to a number of terms and <br />conditions, <br />NOW, THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />LITTLE CANADA, MINNESOTA that the final plat for The Preserve be approved subject to <br />the following terms and conditions as prepared by City Staff: <br />24 <br />
