MINUTES <br />CITY COUNCIL <br />SIrPTIrMBIrR 28, 2005 <br />Upon motion by Blesener, seconded by Keis, the public hearing was <br />closed. <br />Blesener stated that he did not see much option for the Council other than <br />to approve the Final Plat. He noted that if the development meets all the <br />recommendations of consultants and staff and meets the City's ordinance <br />requirements, he sees no option other than to approve it. Blesener noted <br />that the developer has agreed to all but a few of the recommendations. <br />Those that he has not agreed with, he has indicated he will do further <br />research into and work with the city. Blesener further noted that the court <br />has indicated that the City must act on this Final Plat by Friday. <br />LaValle pointed out that the court has mandated that the City approve this <br />Final Plat. LaValle stated that it was his feeling that the developmenC was <br />too dense, and he would prefer to see a 6 to 8 lot development. LaValle <br />noted that the developmenC as proposed will devastate Che trees in the area. <br />The City Administrator stated that the court is not controlling the plat at <br />this time, but the Council's approval is governed by the City's ordinances. <br />The Administrator noted that three of the issues that were presented to the <br />court by the developer, the developer has now made concessions on and <br />voluntarily complied with. The Administrator indicated that while there <br />can be disagreement with the plat on an emotional level, the City's <br />function is to see that the plat complies with City codes. The <br />Administrator indicated that staff is not saying that the project will be an <br />easy one to build, staff is considering the project relative to compliance <br />with City codes and State law. <br />Allan stated that she disagreed with the plat on all levels, and felC that the <br />proposed development has not been well researched relative to impact and <br />feasibility. Allan noted that City staff has reviewed this development over <br />and over, and it does not seem that Che developer does the work that <br />should be done. Allan stated that she was not confident that the developer <br />would work to minimize impact on existing trees as he indicated earlier <br />this evening. Allan felt that pipeline safety was the number one issue, and <br />pointed out that an accident will affect people first and then the wetland <br />area. <br />Keis stated that he did not especially like Che Final Plat as proposed, but <br />did not see how he could vote against it if the plat meets the City's <br />ordinance requirements. <br />Montour stated that this plat has been under more scrutiny than any other <br />he can recall. There has been a lot of discussion and consideration, none <br />of which has been done lightheartedly. Montour stated that this is a <br />23 <br />
