MINUTES <br />CITY COUNCIL <br />SEPTEMBER 28, 2005 <br />REZONE Allan introduced the following resolution and moved its adoption: <br />GERVAIS <br />MILL PARK RESOLUTION NO. 2005-9-232 -CALLING FOR A PUBLIC <br />AND HEARING TO CONSIDER THE REZONING OF THE GERVAIS <br />NADEAU MILL PARK AND NADEAU PARK PROPERTIES FROM <br />PARK SINGLE-FAMILY RESIDENTIAL (R-I) TO PUBLIC (P)AS <br /> RECOMMENDED BY THE PARKS & RECREATION COMMISSION <br /> FOR WEDNESDAY, OCTOBER 26, 2005 <br />The foregoing resolution was duly seconded by Montour. <br />Ayes (5). <br />Nays (0). Resolution declared adopted. <br />PARK CHARGE The City Administrator reported that currently the City's Code only <br />FOR requires the collection of a park charge on commercial properties when <br />COMMERCIAL a subdivision is involved. The Parks & Recreation Commission is <br />PROPERTIES recommending that the Code be changed to require a park charge on the <br />development of all commercial properties, regardless of whether a <br />subdivision occurs or not. <br />The City Attorney reported that State Law requires that a subdivision be <br />part of a commercial property development in order to trigger the <br />requirements for a park charge. Therefore, the City does not have Che <br />authority to amend the Code as recommended. <br />SHERMAN The City Administrator reported that Sherman Associates will be <br />ASSOCIATES scheduling a groundbreaking ceremony for the office building at the <br />northeast corner of Rice Street and Little Canada Road. They have asked <br />for dates that the Mayor and Council are available. The consensus was for <br />Monday, October 17, at 4 p.m. <br />THANKS Montour extended thanks on behalf of the entire Council to the Public <br />TO PUBLIC Works Department and other City staff for their work in cleaning up <br />WORKS after the recent storm event. <br />ADJOURN Mr. LaValle introduced Che following resolution and moved its adoption: <br />RESOLUTION NO. 2005-9-233 -ADJOURNING <br />The foregoing resolution was duly seconded by Keis. <br />Ayes (5). <br />Nays (0).
