MINUTES CITY COUNCIL SEPTEMBER 28, 2005 REZONE Allan introduced the following resolution and moved its adoption: GERVAIS MILL PARK RESOLUTION NO. 2005-9-232 -CALLING FOR A PUBLIC AND HEARING TO CONSIDER THE REZONING OF THE GERVAIS NADEAU MILL PARK AND NADEAU PARK PROPERTIES FROM PARK SINGLE-FAMILY RESIDENTIAL (R-I) TO PUBLIC (P)AS RECOMMENDED BY THE PARKS & RECREATION COMMISSION FOR WEDNESDAY, OCTOBER 26, 2005 The foregoing resolution was duly seconded by Montour. Ayes (5). Nays (0). Resolution declared adopted. PARK CHARGE The City Administrator reported that currently the City's Code only FOR requires the collection of a park charge on commercial properties when COMMERCIAL a subdivision is involved. The Parks & Recreation Commission is PROPERTIES recommending that the Code be changed to require a park charge on the development of all commercial properties, regardless of whether a subdivision occurs or not. The City Attorney reported that State Law requires that a subdivision be part of a commercial property development in order to trigger the requirements for a park charge. Therefore, the City does not have Che authority to amend the Code as recommended. SHERMAN The City Administrator reported that Sherman Associates will be ASSOCIATES scheduling a groundbreaking ceremony for the office building at the northeast corner of Rice Street and Little Canada Road. They have asked for dates that the Mayor and Council are available. The consensus was for Monday, October 17, at 4 p.m. THANKS Montour extended thanks on behalf of the entire Council to the Public TO PUBLIC Works Department and other City staff for their work in cleaning up WORKS after the recent storm event.
