MINUTES <br />CITY COUNCIL <br />SEPTEMBER 28, 2005 <br />There was no one present fiom the general public wishing to comment on <br />this matCer. <br />Upon motion by LaValle, seconded by Keis, the public hearing was <br />closed. <br />Blesener asked if the proposed garage met all architectural requirements. <br />The City Planner replied that it did and would be constructed to match the <br />existing house. The garage height is under the City's 15-foot maximum. <br />Mr. LaValle introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2005-9-224 -APPROVING THE CONDITINAL <br />USE PERMIT ALLOWING A SECOND GARAGE ON A PROPERTY <br />AS WELL AS TOTAL GARAGE SPACE OVER 1,000 SQUARE FEET <br />FOR 2875 CENTERVILLE ROAD AS REQUESTED BY ED AND <br />NANCY NOVAK PENDING COMPLIANCE WITH THE <br />RECOMMENDATIONS OF THE CITY PLANNER AND THE <br />PLANNING COMMISSION <br />The foregoing resolution was duly seconded by Blesener. <br />Ayes (5). <br />Nays (0). Resolution declared adopted. <br />TINAL PLAT- Mayor Blesener opened Che Public Hearing to review Che Final Plat <br />DAYSPRING known as Dayspring Preserve consisting of fourteen (14) single-family <br />PRESERVE lots proposed by Dayspring Development. Blesener noted that the <br />Preliminary Plat for The Preserve was firsC presented to the City in 2002 <br />and was approved with conditions in October of 2002. The main <br />conditions included in the Preliminary Plat approval were there be a road <br />connection to Viking Drive (Preserve Trail), that road connection is <br />centered within the lot, and that recommendations of the City Planner and <br />City Engineer be complied with. The main conditions set forCh by Che City <br />Planner and City Engineer were that Preserve Court have an <br />unencumbered right-of-way and that the two most easterly lots be <br />combined into one. <br />Blesener reported that Che developer submitted a Final PlaC in 2003. In <br />August of 2003 the City Council denied the Final Plat as it was <br />substantially different from the Preliminary Plat as well as the fact that <br />there was information missing on a number of issues. Blesener noted that <br />the issues of concern with the Final Plat included the height of proposed <br />retaining walls, Preserve Court right-of-way was encumbered, there were <br />concerns with proposed outlots, grading, drainage, and soil erosion.
