MINUTES <br />CITY COUNCIL <br />SEPTEMBER 28, 2005 <br />was a 10-foot high retaining wall supporting Preserve Court. Preserve <br />Trail was not centered in the lot. The Final Plat did not meet the City's <br />Pipeline Policy nor did it meet Che Watershed's requirements. <br />Blesener noted that there have been a number of meetings and proceedings <br />since the 2003 Final Plat denial. The judge has ordered Dayspring to <br />apply for Final Plat approval by September 15, 2005, which they did. The <br />City then has until September 30, 2005 to acC on the Final Plat. <br />Blesener reported that in considering this Final Plat, the judge has <br />indicated that the City cannot enforce its Pipeline Policy. However, the <br />City can hold the Final Plat to compliance with its City's Subdivision <br />Ordinances. <br />Blesener reported that City staff and consultants have reviewed the Final <br />Plat submission and have prepared a report outlining the results of that <br />review. That report has been made available to Dayspring Development. <br />In that report, City staff and consultants aye recommending approval of the <br />Final Plat subject to a number of conditions and requirements. Blesener <br />noted that in complying with these conditions, the Final Plat will meet the <br />City's Subdivision Ordinance. He also noted that the developer is <br />requesting no rezonings or variances. Blesener indicated that based on the <br />plat's compliance with the Subdivision Code, he would have a difficult <br />time in voting against the Final Plat. <br />The City Administrator indicated Chat the biggest change in the Final P1aC <br />that is now before the City, is that the plat is much more consistent with <br />the existing grades of the area. There will still be substantial grading done <br />as part of the development; however, the need for 10-foot retaining walls <br />supporting the road and house pads has been eliminated. The <br />Administrator pointed ouC that what has allowed for this change is that <br />Magellan Midstream ParCners (formerly Williams Pipeline) has agreed Co <br />lower its pipeline by approximately 7 feet where it crosses under Preserve <br />Trail. The Administrator reported that the City has received no detail on <br />the lowering of the pipeline as of yet, however, those plans would be <br />subjecC to extensive review. The Administrator also noted that the <br />Ramsey Washington Metro Watershed District has not yet acted on the <br />Final Plat. Therefore, any approval this evening would be subject to the <br />Watershed's review. <br />Kevin Von Riedel, Dayspring Development, reported that he is here this <br />evening with Kevin Gardener of Metro Land Surveying and Mark England <br />of Hanson Homes. Von Riedel reviewed the proposed Final Plat and <br />noted that the difference between this Final Plat and Che Preliminary Plat <br />ChaC was approved by the City is that Preserve Trail is more centered <br />within the Viking Drive lot.
