MINUTES <br />CITY COUNCIL <br />DECEMBER 14, 2005 <br />agreement, and felt a lot of the conditions would be waived as the project <br />progressed. He noted that one condition is the ability to negotiate off-site <br />ponding with MN DOT. Plowman reported that off-site ponding would <br />allow them to develop a 22,000 square foot building. If ponding must be <br />on-site, only a 15,000 square foot building could be developed, which <br />makes the site unusable for TOPC. Plowman was hopeful that they would <br />be able to resolve the ponding issue with MN DOT in the next 45 days. <br />Blesener stated that, at this point, he is not sure which project would be the <br />most beneficial for the City. He noted that without the off-site ponding, <br />the 22,000 square foot distribution center is not possible. He also noted <br />the potential for atax-exempt development with the assisted living project. <br />Blesener stated that he also wanted to look at Coatney's Goose Lake <br />development. <br />Allan asked about h•affic to and from the distribution center. Plowman <br />again indicated that there would be four to five semis delivering to the site <br />over athree-day period each week. There would also be approximately 12 <br />small vans in and out of the site each workday. There would be 15 to 20 <br />personnel working at the distribution center. Plowman reported that their <br />plan would be to develop the distribution center in complement to the St. <br />Jude's building and landscaping. Plowman again stated that the off-site <br />ponding issue should be resolved within the next 45 days. <br />The consensus of the Council was to bring the purchase agreements back <br />at either the first or second meeting in January. This would give the <br />Council time to review the purchase agreements, Plowman time to work <br />with MN DOT on the ponding issues, as well as the City Attorney time to <br />research the issue of tax-exempt potential for the assisted living proposal. <br />The Council asked that Plowman have some sketches showing what the <br />building and landscaping would look Like when this matter comes back for <br />review. <br />LEGAL Mr. LaValle introduced the following resolution and moved its adoption: <br />RETAINER <br />AGREEMENT RESOLUTION NO. 2005-12-288 -APPROVING THE 2006 LEGAL <br />SERVICES RETAINER AGREEMENT WITH SWEENEY, BORER, <br />SWEENEY, AND AUTHORIZING THE MAYOR AND CITY <br />ADMINISTRATOR TO EXECUTE ON BEHALF OF THE CITY <br />The foregoing resolution was duly seconded by Montour. <br />Ayes (5). <br />Nays (0). Resolution declared adopted. <br />
