MINUTES <br />CITY COUNCIL <br />JUNE 25, 2008 <br />SETTLEMENT has approved the agreement. Once Little Canada approves, the City of <br />AGREEMENT Vadnais Heights will issue Little Canada a check for $170,000. <br />The City Administrator reported that the City Attorney did an excellent <br />job to get this case settled. He noted that Little Canada did not achieve <br />full repayment of its principal, but it could be argued that Vadnais Heights <br />is paying more that it is legally obligated to. Both cities moved off their <br />respective positions in agreeing to the settlement. The Administrator did <br />state, however, that Little Canada is disappointed in the $170,000 <br />settlement amount. <br />Blesener stated that he understands the legal aspects of the situation, but <br />felt there was a matter of ethics involved. Keis agreed, noting that <br />Vadnais Heights is an adjacent city that Little Canada has to work with. <br />Keis felt that some moral obligations got missed in this settlement. <br />Mr. Montour introduced the following resolution and moved its adoption: <br />RESOL DTION NO.2008-6-160 -APPROVING THE SETTLEMENT <br />AGREEMENT WITH THE CITY OF VADNAIS HEIGHTS AS <br />PRESENTED BY THE CITYATTORNEY <br />The foregoing resolution was duly seconded by Allan. <br />Ayes (3) Montour, Allan, McGraw. <br />Nays (2) Blesener, Keis. Resolution declared adopted. <br />SAVAGE McGraw recapped the Savage Lake meeting that was held on Tuesday, <br />LAKE June 17, 2008 with residents in the Savage Lake drainage area. He <br />MEETING noted that Cliff Aichinger, Ramsey-Washington Metro Watershed <br />RECAP District did a very good job of presenting a lot of information. McGraw <br />felt that the biggest issues the neighbors have are the high water mark for <br />Savage Lake, how and when it was set, its impact on the lake, and the <br />water lilies that have taken over the west side of the lake. McGraw <br />indicated that most of the neighbors present want the water level raised <br />and want the water lilies gone. <br />McGraw reported that Aichinger gave the property owners some <br />encouragement on how to accomplish both through the DNR. Aichinger <br />indicated that if that avenue was not successful, the City's legislative <br />representatives would need to get involved. McGraw pointed out that the <br />treatment of the water lilies would be at the property owners' expense. <br />While the DNR has approved some treatment of the water lilies, McGraw <br />felt that more was warranted given that there had never been water lilies <br />on West Savage Lake in the past. <br />
