Hanson <br />At your Niay 6°i meetin<r the Commission voted to recommend that cash be accepted in lieu of land <br />for the park charge on the proposed Gervais Hills residential development. In staff's further review <br />of this issue, it became apparent that this development presented an opportunity to address drainage <br />problems on County Road B-2. One option to do this would be to take a land dedication in lieu of the <br />cash park charge in order to accommodate additional storm water ponding/passive recreational <br />development. <br />In a July 21" letter to the developer (copy attached), staff noted its concerns with the proposed <br />development and outlined the possibility of a land dedication in lieu of cash park charge. The <br />developer is not in favor of this option due to the potential loss of one buildable lot. He is also <br />questionin<r our legal aLrthority to use a land dedication in this way. To resolve this issue, he has <br />proposed additional ponding within his project without the loss of a lot. The City Engineer is <br />evaluating this revised submittal and will be commenting on the adequacy of this additional ponding <br />for the development and the County Road B-3 drainage problems. <br />Staff would like the Parks and Recreation Commission to comment on the use of land dedication <br />versus cash park charge to accommodate the County Road B-2 drainage problem and to provide some <br />passive open space area in the event that the developer's most recent submittal does not adequately <br />address the drainage problems. <br />cc: john Whitcomb <br />
