MINUTES PLANNING COMMISSION APRIL 8, 2004 developer on the right-of--way issue, rather than the City taking the right- of-way. Anne Anish, Yorkton Ridge, reported that they moved into the area because of the quiet neighborhood and the wildlife. Anish suggested that the number of lots be reduced so that all the wildlife will not be displaced. Mark Grant, Condit Street, indicated that he, john Grant, and the Miller's would rather not see the road go through their property. However, everything has its price. Grant pointed out that a road to Condit Street would go through their garage and would be 31 feet from their side door. Grant indicated that he has atwo-year-old sou that he is concerned about. Grant indicated that he and his brother came up with a price they thought was fair. He indicated that he did not want the City to take the property through eminent domain. Keis pointed out that from a planning standpoint, the Hidden Acres development falls in line with what the City is looking from in developments. Tt also corrects some existing problems by providing through access from Burke Lane and Yorkton Ridge. Keis stated that he did not supporC developing Hidden Acres with a long cul-de-sac. Keis stated that he understood the concerns of the neighborhood, and stated that he would like to see a connection to Condit Street. Keis asked for clarification on the easement issue to Condit Street. The City Planner reported that once the Hidden Acres development was proposed, the City became aware that the driveway easement to Condit Street for the Sam Fasciana property was not properly recorded. At the time the thoroughfare plan was development for the area, it was believed that this driveway easement did exist and this is one of the reasons that the thoroughfare plan was drawn as it was. Barraclough agreed that the Hidden Acres development was not a bad proposal Iie pointed out that the developer has to deal with the conditions as they exist, one of those being that there is no access to Condit Street. Ban'aclough pointed out that Gordie Howe is a reputable developer, and if he states that he has not been able to reach an agreement for acquiring right-of--way to Condit Street, then he believes him. Barraclough pointed out that there is an alternative to coming out to Condit Street, that is the connections to Burke La~~e and to Yorkton Ridge. Barraclough agreed that the jog to Burke Lane was difficult to maneuver a~~d should be redone. Barraclough questioned, however, whether the access to Condit Street should be forced. -g-
