WHEREAS, Owner has indicated his desire to bring both units into compliance with the <br />Minnesota Building Code and to make other improvements to The Property to improve its <br />appearance and livability. That work is henceforth referred to as "The Rehabilitation Project". <br />WHEREAS, Owner has allowed an inspector from the Housing Resource Center to <br />conduct an inspection for the purposes of developing a work scope for rehabilitation of The <br />Property and a cost estimate for same The preliminary work scope is attached as Exhibit C and <br />the cost estimate as Exhibit D. <br />WHEREAS, the Little Canada Board of Adjustment and Appeals is willing to consider <br />re-establishment of "duplex two family status" for the Property subject to the Owner entering <br />into this agreement. <br />WHEREAS, the length of this agreement shall be from date of signature of the parties <br />until completion of The Rehabilitation Project on or before September 1, 2016. <br />NOW THEREFORE, the City and Owner agree as follows: <br />1. The preliminary work scope for rehabilitation of The Property is attached hereto as <br />Exhibit C. Owner and City shall work with Housing Resource Center to modify work scope in a <br />manner that ensures compliance with the Minnesota Building Code as well as the desires of the <br />Owner for the end product. Upon completion of that review, a final work scope shall be <br />prepared by Housing Resource Center and N no further modifications to this work scope may be <br />made by Owner without the written consent of the City and evidence of adequate financing by <br />Owner. (Note: Adequate Financing is defined as an increase in the deposit amount equal to a <br />documented quote by a reputable contractor skilled in the work to be undertaken plus an <br />additional 10% contingency fee.) Items indicated in red on Exhibit C are those the Owner may <br />choose to do himself. If Owner undertakes those items, he agrees to complete them in a timely <br />fashion as established by Housing Resource Center to ensure coordination with other contractors <br />working on the rehabilitation project. <br />2. Owner acknowledges the need to obtain a building permit for the rehabilitation <br />work to be undertaken. He further acknowledges the City's Building Official shall also be <br />2 <br />
