Hanson <br />Attached is a request from El Sombrero Mexican Restaurant for a text amendment to increase the <br />number of On -Sale Liquor Licenses in the City so that they can make application for said <br />license. <br />The City Code currently limits On -Sale Liquor Licenses as follows: <br />Five (5) On -Sale Liquor Licenses — these are held by Brady's, Gordies, Hoggsbreath, <br />Little Venetian, Saxon Lanes; <br />One (1) On -Sale Restaurant Liquor License — held by Porterhouse; <br />One (1) On -Sale Restaurant -Event Center Liquor License — held by JJ's Hospitality (the <br />event center in the Marketplace Shopping Center). <br />It should be noted that while all available On -Sale Liquor Licenses as delineated in our <br />ordinance are currently taken, the City is authorized under State Statute for additional On -Sale <br />Liquor Licenses. State Statute allows the City up to six (6) On -Sale Liquor Licenses, plus two <br />(2) additional On -Sale Liquor Licenses authorized by Chapter 240, 2987 Laws. State Statute <br />also allows the City an unlimited number of On -Sale Restaurant Liquor Licenses. A further note <br />is that the City has an unlimited number of On -Sale Wine Licenses and On -Sale 3.2 Licenses. <br />To "create" an additional license, an ordinance amendment will be necessary. <br />If the Council wishes to consider the request of El Sombrero Mexican Restaurant, it would be <br />staff's reconunendation that the On -Sale Liquor License fall into the restaurant category with <br />specific conditions attached to the license. It should be noted that the general On -Sale Liquor <br />License could be issued, but this license is the typical bar license, so there would be nothing to <br />prevent El Sombrero from converting the business to a bar if they chose to.
