Section 703.030 details the specific conditions for the On - <br />Sale Restaurant License Liquor License held by Porterhouse, and Section 703.035 details the <br />conditions for the On -Sale Restaurant -Event Center Intoxicating Liquor License held by JJ's <br />Hospitality, <br />With regard to conditions, El Sombrero will not meet the minimum investment requirements <br />under the On -Sale Restaurant Liquor License. The Building Inspector estimated that they will <br />occupy approximately 3,500 square feet of the Marketplace Shopping Center. Also the current <br />building permit they have for their remodel was for $3,000 in improvements. Based on a quick <br />calculation utilizing the property's estimated market value and the percentage of square feet <br />occupied, El Sombrero would have just under $200,000 investment in the property, <br />If the Council supports the request to amend the Code to provide for an additional liquor license, <br />staff is recommending that the license be an On -Sale Restaurant License, Staff is also proposing <br />that the minimum standards under Chapter 703,030, On -Sale Restaurant License, be modified as <br />follows: <br />o Eliminate 703.030 (1) Initial Investment. It is staff's position that this initial <br />investment standard is no longer necessary and that other minimum standards <br />would ensure that the license is being issued to a restaurant versus a bar. <br />o Add a standard requiring a full-service kitchen similar to 703.035 (2). This <br />section could read as follows: <br />■ A restaurant shall have a full-service kitchen equipped with adequate <br />personnel, equipment, and food to prepare meals. Food service shall be <br />required during all business hours when intoxicating liquors are sold, <br />served, or consumed. <br />o Add a standard prohibiting a 2 A.M.
