Heller shall be paid for any accrued PTO, However, in the event Heller is terminated because <br />of her conviction for any illegal act involving personal gain to her, then City shall have no <br />obligation to pay the aggregate salary and PTO as provided in this paragraph. <br />If prior to November2, 2016, City reduces the salary or other financial benefits to <br />Heller in a greater percentage than across-the-board reduction for all City employees, or if <br />City refuses, .following written notice, to comply with any other provisions of this Agreement <br />benefiting Heller, then Heller may, at her option, be deemed to be "terminated" on the date of <br />such reduction or refusal to comply with the provisions of this Agreement, In this event, <br />Helier shall be entitled to severance pay in accordance with this Agreement, <br />If Heller voluntarily resigns her position with the City, Heller agrees to give City twenty-eight <br />(28) days advance notice, If Heller voluntarily resigns her position with City, there shall be no <br />severance pay due to Heller, except as provided for in Section 14 of the City's Personnel <br />Policy dealing with PTO. <br />16. • O }iER PROYI$101yS TO AIWA. Heller shall be subject to Section 17 of City's <br />Personnel Policy entitled "Computer Use Policy" and Section 18 "Other Information" during <br />her tenure with City. Heller acknowledges receipt of this section as well as any other sections <br />of the Personnel Policy previously referenced in this Agreement, <br />17. SVT",RABI,,I''X, If any provision, or any portion thereof, contained in this Agreement is <br />held to be unconstitutional, invalid, or unenforceable, the remainder of this Agreement, or <br />portions thereof, shall be deemed severable, shall not be affected, and shall remain in full <br />force and effect. <br />18, EI'IL !;CT1VE DATE. This Agreement shall become effective November 2, 2015. <br />
