MINUTES <br />CITY COUNCIL <br />OCTOBER 14, 2015 <br />REZONING, <br />PUD PERMIT <br />& IUP PERMIT - <br />3100 COUNTRY <br />DRIVE- <br />SCHWALBACH <br />Keis opened the Public Hearing to consider the Rezoning from Public (P) <br />District to Planned Unit Development (PUD) District for usage of 3100 <br />Country Drive as a multi -tenant industrial building and PUD Permits for <br />outdoor storage for all or some of the tenants of this property as requested <br />by Jim Schwalbach. <br />The City Administrator reported that 3100 Country Drive is the former <br />Public Works Garage which is being sold to Jim Schwalbach of North <br />Heights Hardware. The Administrator reviewed the City Planner's report <br />dated October 5, 2015 outline the Rezoning and PUD Permit requests. <br />The Administrator noted that the Planner has indicated that the proposed <br />use is appropriate for this property. He also noted that one of the <br />conditions of the sale of the property was that Schwalbach would be <br />allowed outdoor storage in the same outdoor storage area that was used by <br />Public Works. The Administrator noted that the Planning Commission <br />has recommended approval of the Rezoning and the PUD Permits subject <br />to compliance with the recommendations of the City Planner. <br />The Administrator indicated that City staff has concern with the <br />recommendation of the Planner and the Planning Commission relative to <br />an Interim Use Permit for outdoor storage for businesses that do not have <br />a space within the building. The Administrator noted that this type of <br />outdoor storage is only allowed in the I-1 District. The Administrator also <br />indicated that it was his understanding that Mr. Schwalbach was only <br />interested in leasing outdoor storage space to a business that also had a <br />presence within the building. <br />Jim Schwalbach, North Heights Hardware, agreed it was his intention that <br />outdoor storage space would only be leased to building tenants. <br />Montour clarified that outdoor storage would only occur in the same area <br />that was used by Public Works for outdoor storage. Schwalbach replied <br />that that was correct. <br />There was no one present from the general public wishing to comment on <br />this matter. <br />Upon motion by Montour, seconded by McGraw, the public hearing was <br />closed. <br />Montour introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2015-10-194 — APPROVING THE REZONING OF <br />3100 COUNTRY DRIVE FROM PUBLIC (P) DISTRICT TO <br />3 <br />
