1VIINUTES <br />PLANNING COMMISSION <br />JULY 8, 2004 <br />Dick Kneeland, 695 County Road B-2, stated that he would like <br />assurances that the drainage from this site will not increase the levels of <br />his pond. Keis acknowledged that drainage is a major concern and <br />pointed out that the Watershed will be reviewing this development <br />proposal. I{neeland expressed concern about the drainage from this plat <br />and the impact to his property. <br />Rheaume pointed out that there are a lot of questions related to drainage, <br />although it appears that the developer may be meeting the minimum <br />requirements. Rheaume felt that the City should ensure that the property <br />is developed right, and noted that he had concerns about the drainage. <br />Dave Sneider, attorney representing Mr. Whitcomb, felt that the comments <br />made by the neighbors were sincere and accurate, but were related to the <br />property in its existing condition. Sneider pointed out that there are <br />existing drainage problems in the area. 1 Te also noted the City's <br />ordinances and the Watershed's controls related to run-off. Sneider stated <br />that currently run-off is not being controlled. The development proposal is <br />an improvement over existing conditions and fulfills their obligations for <br />controlling run-off fl~om this property. <br />Keis pointed out that the Commission has reports from the City Engineer, <br />but not the Watershed. Keis noted that once the development is <br />completed, the drainage will either improve, worsen, or stay the same. If <br />it gets worse, what will the City do at that point. <br />Sneider pointed out that that is why the City has its consultants to review <br />plans and make recommendations. Sneider noted that preliminary plat <br />reviews are typically subject to compliance with City consultant <br />recommendations. Sneider stated that the City may not like the Gervais <br />Hi11s plat, but the City must work within the parameters of its ordinances. <br />Sneider stated that the neighbors may not like the Gervais Hills plat, but <br />the science does not support their claims that the drainage situation will <br />worsen. <br />Sneider stated that with regard to trees, they have suggested that they will <br />continue to work with staff to maximize tree preservation. Sneider <br />pointed out, however, that the City has no ordinance on the books <br />prohibiting tree removal However, the developer would like to maximize <br />tree retention as the result will be a better development and more valuable <br />lots. <br />Sneider stated that he recognizes the Planning Commission's decision is <br />not an easy one, and he would suggest that the Commission send the plat <br />_12_ <br />
