MINUTES <br />PLANNING COMMISSION <br />JULY 8, 2004 <br />Loeffler requested that the Commission table action on this matter for <br />another 30 days to allow the property owner an opportunity to sit down <br />with stafFaud work out some options. <br />Groholski asked what the Commission's understanding was relative to the <br />fence, questioning whether or not the fence was being requested by the St. <br />Paul Water Department. The Planner indicated that Mr. Groholski <br />proposed the fence due to his concern about people crossing his property. <br />The City Planner recommended that the Planning Commission take action <br />on the Precision Tree request for Variance and Amendment to CUP <br />pointing out that these issues have been tabled a number of times, and the <br />general public has been waiting for an outcome. <br />Groholski pointed out that the alternative heat source would not be used <br />for the next couple of months, therefore, suggested there was time to table <br />the matter for further study. Loeffler agreed and suggested that Precision <br />Tree would come in with an alternative proposal dw~ing the August <br />planning cycle. <br />Keis felt that the outdoor storage limitations under the Code and the <br />amount of outdoor storage proposed by Precision Tree were so far apart <br />that an acceptable alternative was unlikely. Duray agreed. ,Duray stated <br />that he appreciates the business community of Little Canada, but noted <br />that the City must apply its codes evenly. The amount of outdoor storage <br />being requested was too large of a discrepancy from what is allowed under <br />the Code. It was also noted that the alternative heat source is a nuisance to <br />the neighborhood and must be addressed. <br />Keis recommended denial of the Variance to allow outdoor storage in <br />excess of Code limitations given there is no hardship present to warrant <br />granting t9ie variance, and recommended approval of the Amendment to <br />Conditional Use Permit to modify the site plant to reflect the addition of <br />fuel tanks only, and recommended denial of the Amendment to CUI' for <br />all other additional outdoor storage items including the accessory structure <br />for wood-burning heating systeul, and instructing Precision Tree to retunl <br />the site to compliance with the approved site plan within 90 days. <br />Motion seconded by Wojcik. <br />Motion carried 5 - 0. <br />-7- <br />
