The new wall would be consUUCted with <br />ASSOCIATION boulders. <br />Duray asked how much higher the new wall would be. Hoffman indicated <br />that the wall would be the same height or else slightly higher and the <br />terrain behind the wall would be leveled. Hoffman described the steep <br />terrain behind the townhomes and indicated that this work will provide for <br />a safer and more level backyard area. <br />Weihe recommended approval of the Variance from the Shoreland District <br />setback to allow replacement and extension of the retaining wall at Rowed <br />Lake Trail Townhome Association subject to compliance with the <br />recommendations of the City Planner. <br />Motion seconded by Rheawne. <br />Motion carried 6 - 0. <br />PROPERTY Mr. Oscar Lane, 3069 Arcade Street, appeared before the Commission <br />DIVISION & requesting approval of a Property ,Division allowing a lot line <br />VARIANCE - adjustment and a Variance to allow a building ou a lot with no direct <br />3069 ARCADE street frontage. Lane reported that be is selling the house and the lot, <br />STR:GET - and the new owner would like a larger back yard for the house at 3069 <br />OSCAR LANE Arcade Street. <br />Ban aclough pointed out that this property already exists as two separate <br />parcels, and the request is to make the back yard larger for the existing <br />house, thus move the property line back about 50 feet The vacant lot in <br />the back has street access via a 20-foot easement. F.,ven with the lot line <br />adjustment, the rear lot will more than exceed the City's minimum lot size <br />requirements. <br />'~Che City ]Manner noted that the existing lot does not have full frontage at <br />the street, but is a lot of record. In considering a building permit for this <br />parcel and to ensure that there is no confusion, the sw vey should be drawn <br />to reflect the setbacks with the east and west being considered as the front <br />and rear of the property and the north and south as the sides. <br />1'he Planner noted the letter that was submitted from a neighbor <br />questioning whether variance criteria is being considered as part of this <br />request and the application of this criteria to other properties in the City. <br />The Planner indicated that it is his opinion that the issuance of a Variance <br />for this property does comply with the appropriate criteria given this is a <br />-5- <br />
