MINUTES <br />CITY COUNCIL <br />OCTOBER 28, 2015 <br />that, in the future, the PEG fee for CenturyLink will fluctuate based on the <br />Comcast PEG fee. Bradley reported that State Law says that a second <br />franchisee cannot have a more or less favorable burden relative to PEG fee <br />requirements. <br />Torkelson asked about universal service currently provided by Comcast. <br />Universal service allows people to view PEG channels at no cost. Bradley <br />reported that this is not a requirement under the CenturyLink franchise. <br />Patrick Haggerty, CenturyLink, appeared before the Council and indicated <br />that CenturyLink is very excited about the possibility of providing cable <br />TV service to the NSCC member cities. <br />There was no one from the general public present wishing to comment on <br />this matter. <br />Upon motion by Montour, seconded by McGraw, the public hearing was <br />closed. <br />Montour introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2015-10-207 — APPROVING AN ORDINANCE <br />GRANTING A FRANCHISE TO QWEST BROADBAND SERVICES, <br />INC., DBA CENTURYLINK, TO CONSTRUCT, OPERATE, AND <br />MAINTAINA CABLE COMMUNICATIONS SYSTEM IN THE CITY <br />OF LITTLE CANADA; SETTING FORTH CONDITIONS <br />ACCOMPANYING THE GRANT OF THE FRANCHISE; <br />PROVIDING FOR REGULATION AND USE OF THE SYSTEM AND <br />THE PUBLIC RIGHTS-OF-WAY IN CONJUNCTION WITH THE <br />CITY'S RIGHT-OF-WAY ORDINANCE, IF ANY, AND <br />PRESCRIBING PENALTIES FOR THE VIOLATION OF THE <br />PROVISIONS HEREIN BASED ON THE FINDINGS OF THAT AS <br />OUTLINED IN THE CITY COUNCIL AGENDA PACKET <br />The foregoing resolution was duly seconded by McGraw. <br />Ayes (5). <br />Nays (0). Resolution declared adopted. <br />VanAlstine asked about the video -on -demand feature and how often <br />content could be changed. Bradley replied that content will be able to be <br />changed as often as is desired, and indicated that CenturyLink will provide <br />the appropriate instructions when the process reaches that point. <br />Montour asked where the process moves from here. Bradley replied that <br />once the franchise ordinance is signed, it should be submitted to Coralie <br />7 <br />
