rvIINUTEs <br />PLANNING COMI\9ISSION <br />NOVEMBER 1G, 2004 <br />PLANNED Jake Puhrman and Janel Russell appeared before the Commission <br />UNIT relative to their request for a Planned Unit Development Permit to allow <br />DEVELOPMENT anon-traditional retail business at 28661VIiddle Street in the Market <br />PERMIT - Sgaare Town Offices. Russell indicated that they have received the <br />2866 MIDDLE recommendations of the City Plam~er and are in agreement with them. <br />STREET - She asked about the recommendation that the City reserve the right to <br />JAKE I!i1HRMAN review the permit to ensure that the use has not overburdened the site <br />AND JANEL with parking demand due to ahigher-than-expected ]evel of customer <br />RUSS:GLL traff a Russell asked what the review would consist of as well as how <br /> long the PIJD Permit would run. <br />The City Planner indicated that the PUD Permit would run with the land <br />and as long as a business operates under the conditions of the permit, it <br />would remain in effect. This means that the business could be sold to a <br />similar business and the PU~D Permit would remain in effect. <br />Russell explained the nature of the business which involves the design and <br />licensing of various product categories such as children's clothing, <br />stationary, timepieces, pictwe frames, Christmas ornaments, and jewelry. <br />These designs are licensed to high volume sales channels. Russell <br />explained that they do sell jewelry at retail, but by appointment only. <br />Russell presented the Commission with a floor plan for their space which <br />s1~e pointed out consists primarily of ofice space with no designated retail <br />space. There will be a small display area in the conference room. <br />Kcis asked how the business is advertised. Russell replied that they do no <br />advertising and customers come to them by word-of-mouth. Russell again <br />stated that they were fine with the recommendations of'tfie City Planner, <br />they just wanted additional information on permit review. <br />Keis indicated that the purpose of any future permit review would be to <br />ensrn e that the business is not causing any parking problems, The City <br />Planner indicated that if there are complaints about parking or there is on- <br />street parking from the townoffice complex, the City would review the <br />permit. J<nudsen indicated that there would be a validation of which <br />business is causing the parking problem. Knudsen indicated that the City <br />must make sure that each business is getting the amount of parking that <br />they bargained for. <br />The City Manner explained that the parking requirements for office space <br />are less than for retail space. This project was designed with a certain <br />number of parking spaces for office, and retail use would overburden the <br />parking supply. If there was a complaint, the City would identify which <br />business is overburdening the parking and would try to work with the <br />business to resolve the issue. <br />-5- <br />
