1VIINUTES <br />PLANNING COMMISSION <br />NOVlMBT•;R 16, 2004 <br />PUD Mr. Dicl< Biagini appeared before the Commission requesting a PUD <br />PERMIT - Permit fora 16,000 square foot office building, Biagini indicated that <br />2935 COUNTRY the building would be one-story, slab-ai-grade, and aesthetically <br />DRIVi'; - identical to the building to the sotirth. The proposed office building is <br />DICK fully leased with the existing tenants in the first building. <br />BIAGINI <br />I{eis pointed out the City 'Planner's comment in his repa-f dated <br />November 11, 2004 relative to landscaping and screening for the adjacent <br />residential uses. Biagini felt that landscaping on the north end of the site <br />would be ineffective. I3e also noted that there will be a landscaped area to <br />the west along Condit Street. Biagini relayed the history of the berm that <br />was originally installed on the western edge of the first project, noting that <br />the berm was removed at the request of the City and the adjacent property <br />owners. That bean is landscaped and planted with grass. <br />Elaine Loch indicated that the berm is cw~rently a patch of weeds with <br />dead trees. Zoch submitted pictures of the berm showing its condition. <br />Zoch expressed concern about the process for considering this <br />development She pointed out that work has already begun on the site, <br />and the hearings are just now being held after the work has started. Zoch <br />asked why the developer has begun work before obtaining approvals. <br />Zoch asked why Hie neighborhood is asked to come to a planning meeting <br />to comment on a development that has ah~eady begun. <br />Marcel Zoch suggested that these developments are already cut and dried <br />before the public hearing process begins. <br />The City Administrator indicated that the developer has a Right of Envy <br />with the City that has allowed him to begin the basic utility work and the <br />grading. This work is being done at the developer's risk should the City <br />not grant the appropriate approvals. if the project is denied, the developer <br />will have to remove the utilities and restore the site. The Administrator <br />pointed out that this is the third building that was proposed for this <br />particular site, and reviewed the history of those past proposals. The <br />building that is before the City for approval is not a major deviation from <br />other buildings that were previously approved for this site. <br />Zoch indicated that Mr. Biagini has told them that the building would be <br />located toward the south end of the site. <br />Biagini reported that the trst building he proposed is in the exact location <br />as the one that he is currently proposing. When the tenants backed out of <br />the first building, the plans were changed and he came back with a <br />building that was about 50% warehouse and 50% office. Biagini pointed <br />out that the current building is proposed to be 90% office. <br />-9- <br />
