MINUTES <br />PLANNING COMMISSION <br />DECEMBER 9, 2004 <br />Duray asked about the Watershed's recommmendations for this plat. <br />Whitcomb reported that the >?inal Plat fully complies with all of the <br />recommendations of the Watershed District. <br />Barraclough noted there was neighborhood concern about drainage at <br />Greenbrier Circle and County Road B-2. Whitcomb indicated that the <br />City is aware there is a problem with the volume of water coming down <br />County Road B-2, but is not willing to pay for resolving the problem at <br />this time. The ponding provided as part of the Gervais Hills plat will treat <br />about 80% of the water under the worst case scenario. Whitcomb noted <br />that the added ponding iu the Gervais Hills plat will not totally resolve the <br />County 13oad B-2 drainage problems. <br />The City Planner indicated that he received a letter from MN DOT today <br />relative to the Gervais L-Tills plat MN DOT has some issues related to the <br />permit for construction within their ditch right-of-way. They are asking <br />that construction be stopped until they have a chance to review <br />construction plans as that construction relates to their ditch easement. The <br />Planner noted that this issue does not relate to the layout of the Final Plat. <br />if the Commission is inclined to approve the I'iual Plat, the Planner <br />recommended that approval be subject to resolution of the MN DOT <br />issues. <br />Whitcomb indicated that they have had difficulty in determining the <br />appropriate contact person at MN D07" in order to address the issues <br />raised in their letter. Whitcomb indicated that they are now in the process <br />of working with MN DOT to resolve the matter. Whitcomb noted that <br />only one of the proposed lots is encumbered by the MN DOT right-of- <br />way, and he is aware that this issue will have to be resolved before that lot <br />can be sold. <br />Knudsen pointed out that the City 13,ngineer's letter indicates the developer <br />has accommodated the City's ponding request "to the extent possible". <br />I{nudsen pointed out there is clear adaiowledgement of a drainage <br />problem in the area. He stated that he did not feel it acceptable to <br />accommodate additional ponding "to the extent possible" without reducing <br />the number of lots. <br />Knudsen is concerned about the following considering the breakneck pace <br />of grading of the property since mid November: <br />:• the only time the Commission has heard about the Watershed's <br />requirements is second hand and mostly from the developer himself; <br />:• the developer's claim that he called some guy at MNDOT and it wasn't his <br />fault that ite didn't have the necessary permitting; <br />_3_ <br />
