MINUTES CITY COUNCIL APRIL 14, 2004 Montour asked if access through County Road D would be maintained. Pafko replied that that would depend on the condition of the County Road D roadwork. With regard to the issue of municipal consent for the Unweave the Weave project and the imposition of conditions by the City, Pafko reported that the Attorney General has indicated that unless MN DOT is in agreement with every word of any conditions, a municipal consent with conditions is treated as a denial. Therefore, Paflco requested that the Council act on two separate resolutions for the Unweave the Weave project. One resolution would provide municipal consent. The other resolution would list the issues that the City and MN DOT will continue to work on as relates to the project. Pafko reported that a municipal consent with conditions will likely force the appeal process. Fahey noted that Pafko has indicated MN DOT is agreeable to some of the conditions listed. He felt, therefore, that the mwricipal consent should contain those conditions. Pafko noted that any conditions contained in the municipal consent would have to be reviewed by MN DOT staff. Therefore, at this time, he could not guarantee that the appeal process would not be triggered by those conditions. It was noted that the City of Vadnais I~Ieights has granted municipal consent with conditions. Pafko reported that he has not received the final resolution from Vadnais Heights, therefore, is unsure whether the conditions imposed would trigger the appeal process. Pafko continued the issues review, pointing out that the earlier discussion on the Cooperative Drainage Improvements. Fahey indicated that the regula~~ Council meeting is scheduled to begin at 7:30 p.m.; therefore, this discussion will be continued into that meeting.
