MINUTES <br />CITY COUNCIL <br />NOVEMBER 9, 2015 <br />through the neighborhood if the street became public? Johnson stated that <br />plenty of people still drive through the neighborhood. <br />Johnson asked if the city was willing to entertain something like Prior <br />Lake did to create a procedure for assuming private streets. Keis said <br />there would be a lot of questions and research before they could answer <br />that. City Administrator stated he would need to also research the impact <br />on all private streets. <br />Fischer introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2015-11-217 DENYING THE REQUEST FOR <br />REIMBURSEMENT OF STREET MAINTENANCE COSTS OF <br />PRIVATE STREETS IN COBBLESTONE VILLAGE. <br />The foregoing resolution was duly seconded by Torkelson. <br />Ayes (4). <br />Nays (0). Motion declared adopted. <br />Keis suggested to Johnson that he could research on his own what it would <br />cost to bring their streets up to city code and then approach the city again. <br />PRESENTATION- <br />City Attorney Martin Norder stated that the City Administrator had given <br />QUESTIONS <br />the Council a memo and they had met previously in a closed session about <br />CONCERNING <br />2708 Edgerton. He also stated that he had spoken to Mr. Dacey and said <br />PROPERTY <br />there wasn't much they could talk about tonight. City Attorney told Mr. <br />VIOLATIONS AT <br />Dacey that the city had denied the rental license for 2708 Edgerton and it <br />2708 EDGERTON <br />was now up to the property owner to take action, so it is not a city issue at <br />STREET — JACK <br />this point. If the owner does not do anything, the city could then possibly <br />SCHMIDT & JAY <br />get involved in litigation. <br />DACEY <br />Jay Dacey, 2700 Edgerton Street, stated that when he bought his house <br />eight years ago there were no issues in the neighborhood. Then the <br />tenants next door moved in a few years ago and had 10 dogs that were <br />constantly off -leash and causing problems. He has had to call animal <br />control continuously over the last 3 years and he feels that he and his <br />family cannot safely use their backyard. Both he and the other neighbor, <br />Jack Schmidt, have received letters stating that they would need to testify <br />against the neighbor, but they have never been called to testify and give <br />their side of the story. Dacey stated that he and Schmidt have now been <br />served with a restraining order from the neighbor. He has received <br />conflicting information and wants to know what is going on. <br />
