Peterson indicated that the issues relative to the number of <br />vehicles and the proposed use of outdoor storage closets for recyclables <br />was overlooked at the Planning Commission. Peterson indicated that the <br />City requirement for 29 parking spaces for employees and customers is <br />completely ludicrous. Peterson submitted a letter to the Council from <br />Buck Blacktop regarding the soil conditions of the property in response to <br />discussions at the Planning Commission meeting. <br />Blesener indicated that the grading and drainage issues relative to this <br />property have nothing to do with his position on the application for an <br />Amended CUP and Variance. Blesener referred to the November, 2003 <br />minutes in which Valor made representations that they would not store car <br />clips on the property, only whole vehicles. They also indicated that the <br />majority of cars stored on the site were owned by customers who were <br />responsible for finding replacement parts. Valor also indicated that these <br />cars might be stored for 2 to 3 months while the customer is hying to <br />locate the appropriate parts. Blesener noted that some of the vehicles have <br />been stored for over a year. Blesener indicated that it was his position that <br />Valor is using the property as a salvage yard, and noted that salvage yards <br />are not allowed in the City. <br />Peterson indicated that Valor Enterprises has always represented that cars <br />would be stored and used for parts. <br />Blesener pointed out that Valor was initially allowed to store 20 cars and <br />has had up to 150 cars on the property. There are cwrently 90 vehicles <br />stored on site. Montour noted that the May 5, 2004 visit by the Code <br />Enforcement Officer showed there were 102 cars on the site. <br />Peterson indicated that many of the vehicles have been left by customers. <br />Valor is investigating its options for disposing of these vehicles. Peterson <br />indicated that at the time of the original CUP approval the discussion was <br />that Valor needed to be able to store 20 vehicles, but they were led to <br />believe that they could store a reasonable amount of vehicles. At that <br />time, the storage limitations were reasonable. However, since 9-I 1 the <br />nature of the business has changed. <br />Anderson noted that 20 vehicles were allowed and because of changes in <br />the business there were 102 vehicles on site in early May. Anderson <br />expressed concern that if the City increases the storage to 60 vehicles, that <br />actual storage numbers may exceed 300. Anderson stated that he has no <br />confidence that if the City increases the number of allowed vehicles that <br />Valor will comply with that number. Anderson also noted that Valor is <br />requesting a change in location of storage areas given their claims of <br />drainage problems on the property. Anderson stated that while he is not <br />disputing the water problem, he was concerned that Valor has not <br />complied with the initial CUP. <br />
