MINUTES <br />CITY COUNCIL <br />MAY 26, 2004 <br />Peterson stated that the location change was suggested by the Planning <br />Commission as they understood that the business does not need employee <br />and customer parking spaces. <br />Fahey asked if the 29 parking spaces are required by ordinance. The City <br />Planner confirmed that 29 parking spaces are required. The City <br />Administrator pointed out that the ordinance provides for a lesser number <br />of spaces provided that the property owner provide proof of the ability to <br />add future parking should the need become apparent. The Administrator <br />indicated that Valor Enterprises did not take advantage of this option. <br />Peterson indicated that Valor was not informed of the option. <br />The Planner disagreed, and it was noted that if the proof of parking option <br />is utilized, the additional required parking must be allocated in green space <br />so that it can be converted to the required parking at the time the need is <br />apparent. The required parking cannot be utilized for another purpose <br />other than green area. <br />Fahey noted that the real issue is that the Valor business has been <br />expanded beyond what was approved and what the City is comfortable <br />with. Fahey pointed out that the City does not want ajunkyard or a <br />vehicle storage lot. Valor must comply with the original CUP <br />requirements and if the property is not suitable for those purposes, then <br />perhaps Valor needs to relocate. Fahey indicated that if Valor does not <br />comply, its license would not be renewed this summer. <br />Peterson indicated that she was of the understanding that the City was <br />willing to discuss the issue, but is now hearing that it is not. <br />Fahey stated that he wanted to make it very clear that drainage is not the <br />issue here. Valor must be in compliance with its original CUP approval or <br />the City will take enforcement action and will not renew Valor's license. <br />Blesener agreed that the real issue is the expansion of a use that he is not <br />in favor of Blesener pointed out that Valor is operating a salvage yard <br />and is requesting a larger salvage yard. <br />There was no one from the general public present wishing to comment on <br />this matter. <br />Upon motion by Blesener, seconded by LaValle, the public hearing was <br />closed. <br />LaValle introduced the following resolution and moved its adoption: <br />12 <br />
