MINUTES <br />CITY COUNCIL <br />JUNE 9, 2004 <br />DAYSPRING The City Attorney indicated that the Council must decided whether or <br />DEVELOPMENT not to appeal the court ruling on the Dayspring Development, Inc. versus <br />LITIGATION City of Little Canada litigation. The Attorney indicated that there was no <br />need to call for a closed session at this point. <br />Mr. LaValle introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2004-6-123 -INSTRUCTING THE CITY'S <br />LECAL REPRESENTATION TO PROCEED WITHANAPPEAL OF <br />THE COURT'S DECISION RELATIVE TO THE DAYSPRING <br />DEVELOPMENT, INC. LITIGATIONPURSUANT TO THE <br />DISCUSSION IN THE COUNCIL'S CLOSED SESSION OF MAY 26, <br />2004 <br />The foregoing resolution was duly seconded by Montour. <br />Ayes (5) LaValle, Montour, Anderson, Fahey, Blesener. <br />Nays (0). Resolution declared adopted. <br />NORTH STAR The City Administrator reviewed the need to reject all bids for the <br />ESTATES North Star Estates storm shelter, and rebid the project. The cost of doing <br />STORM so will be paid for by the City's engineering consultant. <br />SHELTER <br />Mr. Montour introduced the following resolution and moved its adoption: <br />RESOL UTION NO. 2004-6-124 -REJECTING THE BIDS FOR THE <br />NORTH STAR ESTATES STORM SHELTER PROJECT AND <br />INSTRUCTING THE CITYENGINEER TO ADVERTISE FOR NEW <br />BIDS FOR THIS PROJECT <br />The foregoing resolution was duly secarded by Anderson. <br />Ayes (5) Montour, Anderson, LaValle, Blesener, Fahey. <br />Nays (0). Resolution declared adopted. <br />GOOSE The City Administrator reviewed his memo dated June 4, 2004 relative <br />CONTROL to his recommendation to conduct a goose round up on the Lakeside pond <br />and the Market Place pond. The Administrator indicated that the City has <br />had minimal success with the goose gun. He also indicated that the City <br />has invested significant dollars in plantings at the Market Place pond and <br />felt a round up was necessary in order to protect those plantings. The <br />Administrator noted the results of a survey done last Friday relative to the <br />numbers of geese at various locations in the City. He also reported that <br />staff had noted that the numbers are substantially higher at certain <br />locations today. The Administrator indicated that his recommendation is <br />
