MINUTES <br />CITY COUNCIL <br />JUNE 23, 2004 <br />CUP FOR <br />RESIDENTIAL <br />PUD TOR <br />DEVIATION <br />IN SIDE YARD <br />SETBACKS- <br />HIDDEN ACRES <br />Anderson suggested 8 feet rather than 7'/z feet feeling that would be a <br />clearer standard. <br />Montour asked in an individual property owner could request a PUD. The <br />City Planner replied that a PUD designation is a way to allow a trade off <br />from a regulation for other benefits to a project that could not be required <br />as a part of basic zoning. In the case of Hidden Acres, the developer is <br />requesting side yard setback flexibility under a PUD in order to design a <br />house that he feels would be more aesthetically pleasing for the area. <br />There was no one present from the general public wishing to comment on <br />this matter. <br />Upon motion by Blesener, seconded by LaValle, the public hearing was <br />closed. <br />Fahey stated that he was comfortable with a 7 '/z foot side yard setback <br />standard in the R-1 District. <br />Mr. Fahey introduced the following resolution and moved its adoption: <br />RESOI UTIONNO. 2004-6-137 -AMENTING CHAPTER 905.050 OF <br />I'HE LITTLE CANADA CITY CODE, KNOWN AS THE ZONING <br />OXDINANCE,I3Y PROVIDING FOR A REDUCTION INSIDE YARD <br />SET73ACKS IN THE SINGL E-FAMILY RESIDENTIAL DISTRICT <br />(R-I) FROM %EN (10) FEET TO SEVEN AND ONE-HAI F (7'/z) <br />FEET IN ORDER TO MAIN'L'AIN A MINIMUM FIFTEEN (l5) <br />FOOT .STRUCTURE SEPARATION <br />The foregoing resolution was duly seconded by LaValle. <br />Ayes (4) Fahey, LaValle, Montour, Anderson. <br />Nays ('1) Blesener. Resolution declared adopted. <br />Mayor Fahey opened the continuation of Public Hearing to consider a <br />Conditional Use Permit for a Residential Planned Unit Development to <br />allow a deviation in side yard setbacks. <br />There was no one present from the general public wishing to comment <br />on this matter. <br />Upon motion by Blesener, seconded by LaValle, the public hearing was <br />closed. <br />Given the Council's previous action amending the R-] Zoning Code <br />reducing side yard setbacks, the developers need for the CUP has been <br />negated. <br />4 <br />
