The Administrator reported that if used guns are <br />being sold, however, a second hand goods dealer's license would be <br />required The Administrator indicated that at the point he became aware <br />of Mr. Kennedy's intentions, the City informed him that gun stores were <br />not permitted as a principal use. <br />Blesener noted that if the Code is amended to allow gun shops, the City <br />must establish the proper guidelines and controls to protect the residents of <br />Little Canada as there will be additional requests for gun shops. <br />Hendricks asked if Mr. Kennedy could open his gun shop up on a <br />temporary basis unfit his lease is up. <br />Fahey replied that gun shops are not a permitted principal use; therefore, <br />the store could not be opened under a temporary situation. Fahey again <br />indicated his support for a zoning study to determine what other cities are <br />doing as well as to obtain input from the Sheriff s Department. Fahey <br />indicated that he does not have enough information this evening to make a <br />decision. Fahey suggested that the matter be brought back to the July 28'x' <br />meeting. <br />Anderson asked if Mr. Kennedy was able to operate the store in the <br />meantime without gun sales. Kennedy indicated that it would be a <br />hardship to do so, and reported that the gnu sales are a lure to get people <br />into the store for his other products. <br />The City Administrator noted that he has reviewed Mi~. Kennedy's lease <br />which has a clause that would allow ICemiedy to break the ]ease if he were <br />not able to obtain City approval. <br />Fahey stated that he was not willing to make a policy decision based on <br />M,r. Kennedy's economic circumstances. Fahey again stated that the <br />matter would be scheduled for review at the July 28'x' Council meeting <br />pending a zoning use study and input from the Sheriff's Department. <br />Council agreed- <br />CONSENT Mr. LaValle introduced the following resolution and moved its adoption: <br />AGCNDA <br />RESOLUTION NO. 2004-7,142 -APPROVING THF.
