MINUTES <br />CITY COUNCIL <br />AUGUST 11, 2004 <br />CITY The City Administrator reported that Lee Elfering left Howard R. Green <br />ENGINEER Company and has established his own engineering firm. The <br />DISCUSSION Administrator further reported that he has had discussions with Mr. <br />Elfering about continuing on as the City's engineer and noted the financial <br />details provided in the agenda. The Administrator indicated it was his <br />belief t7rat the Elfering Associates proposal provided greater economic <br />advantages to the City than the Howard R. Green does. He also indicated <br />that Mr. Elfering is a very proficient engineer, has done a good job for the <br />City, and is very familiar with Little Canada, The Administrator pointed <br />out that given Mr. Elfering's resignation from Howard R. Green <br />Company, the City would be starting over with a newly assigned engineer <br />from that firm. <br />Fahey asked if Mr. Elfering has anon-compete agreement with Howard R. <br />Green. Elfering replied that he did and would have to forfeit 30% of the <br />value of his stock in the company. Elfering pointed out that there would <br />be no (iability to Little Canada in contracting with his f rm. <br />Elfering reported that his 8rm has the expertise to do their own drafting <br />work and will be hiring the appropriate support staff as their business <br />grows. These support services will be hired on a consultant basis initially. <br />Fahey noted that the engineering services provided in the past by Mr. <br />Elfering have been of high quality and the City has received minimal <br />complaints related to its projects. Fahey stated that he has been please <br />with the work Mr. Elfering has done. He also noted that the City <br />Administrator will be overseeing the situation on the City's behalf. <br />Anderson asked if the City has an established process for seeking <br />consultant services. The City Administrator replied that there is no <br />established process, and noted that Howard R. Green Company was hired <br />in 1998 as the result of dissatisfaction with the previous engineering firm. <br />The Administrator pointed out that continuing with the Mr. Elfering will <br />provide the City with a lot of efficiencies, rather than starting over with a <br />new engineer at Howard R. Green Company. <br />The Administrator indicated that if the Council hires Elfering Associates, <br />Howard R. Green Company will complete the City's 2004 projects. Any <br />new project would be referred to Elfering Associates. However, a formal <br />transition plan would be developed to govern this process. <br />Anderson suggested that in moving forward with contract negotiations, <br />Elfering Associates should be required to have professional liability <br />insw ance. <br />Mr. I'ahey introduced the following resolution and moved its adoption: <br />9 <br />
