M1NUT~s <br />CITY COUNC,iL <br />SEPTUMB7JR 22, 2004 <br />Snyder noted that the Administrator's July 21 ~' memo indicates that City <br />staff would like to review this pondiug issue with the developer in greater <br />detail to complement the existing drainage system while addressing <br />existing problems in the neighborhood. Snyder again indicated that if the <br />City occupies someone else's property to resolve a regional issue, there <br />would be just compensation due. Snyder stated that the developer would <br />like to offer a solution to the situation. <br />Whitcomb proposed that the cul-de-sac be shifted back by approximately <br />60 feet, moving the lots further south, and allowing for a larger pond to be <br />installed along County Road B-2 without the loss of Lot 1. <br />Snyder pointed out that Lot l would be retained. Snyder also proposed <br />that the City would waive its cash park charge in exchange for the ability <br />to construct a larger pond near County Road F3-2. This proposal would <br />retain the ability to develop 12 lots and would allow the City to address its <br />regional drainage issues. Snyder pointed out that the plat would still <br />comply with all the City's ordinances. <br />Fahey stated that he liked the proposal and suggested that City staff review <br />it and come back with a recommendation. Snyder requested that the <br />Council act ou the Preliminary Plat as being modified subject to the plat <br />meeting the City's ordinance requirements. <br />Allan stated that she would prefer to see the revised drawings before <br />acting on the Preliminary Plat. Both Allan and Blesener noted that the <br />delays in acting on the Preliminary Plat were the result of the developer <br />not processing a Watershed permit on a timely basis. <br />Fahey stated that he could appreciate the suddenness of this revision and <br />also appreciated the developer's proposing this option. Fahey stated that, <br />if necessary, he was willing to call a special meeting to act on the <br />Preliminary Plat once revised drawings were received. Fahey stated that <br />he did not feel comfortable acting on the revision before City staff had a <br />chance to review it. <br />Blesener asked if Mr. Engstrom was willing to give up laud to add to the <br />pondiug area. Mr. Engstrom indicated that he would allow a portion of his <br />property to be sloped toward the pond, but would not give up land for the <br />actual pond itself. <br />Dick Kneeland, property owner across the street from the proposed plat, <br />pointed out that he had a pond on his property. Kneeland was concerned <br />that all the run-off from this development would silt up his pond. <br />Kneeland asked who would be responsible for cleaning his pond. <br />IO <br />
