MINUTES <br />CITY COUNCIL <br />StiPTCMI3ER 22, 2004 <br />Snyider pointed out that the statutory deadline has been extended twice for <br />acting on this play, and requested that the City act this evening so that they <br />could begin grading the property. Snyder pointed out that the plat will <br />comply with all the City's ordinance requirements. The changes proposed <br />increase the cul-de-sac length and adjust lot lines. The City will still have <br />to review and approve the Final Plat. Snyder felt that the adjustments <br />being made were merely an engineering exercise at this point- <br />Fahey agreed that the remaining issues could be resolved before the Final <br />Plat. <br />To address Mr. I{neeland's question, the City Administrator indicated that <br />the developer would be responsible for sedimentation control during <br />construction. After the development is complete and the developer is <br />gone, then the City and the Watershed would be responsible. The <br />Administrator pointed out that the developer would like to begin grading <br />the property, but grading cannot commence until after the Watershed <br />reviews the plat at their October 6°' meeting and issues its permit. The <br />Administrator noted that the 60-day waiver signed by the developer rw~s <br />through September 27°'- The Administrator suggested that the Council <br />could call a special meeting for September 27°', and the developer could <br />revise their plans and submit them for review at that meeting. <br />Whitcomb noted that part of the reason for beginning grading this fall is to <br />avoid having to grade in the spring when there is more potential for rain to <br />wash sediment. Whitcomb indicated that if the Watershed issues the <br />permit on October 6°i, they would like to begin grading on October 7°'. <br />Whitcomb indicated that they had no problem extending the cul-de-sac to <br />provide additional area for a pond along County Road B-2 as long as they <br />were able to develop 12 lots. Whitcomb again noted that this lots will <br />meet City ordinance requirements. <br />The City Engineer stated that if the cul-de-sac is extended by 60 feet, it <br />appears the County Road 'B-2 pond would fit while retaining the 12 lots. <br />However, 1~e would have to review the impact on buildable area for each <br />of the lots- <br />Fahey suggested approval of the Preliminary Plat as revised subject to <br />compliance with the l l conditions outlined by City staiTand subject to <br />meeting all ordinance requirements. 131esener pointed out that the City <br />will still have control as it has to act on the Final Plat. <br />I?ngstrom asked the depth of the proposed ponds.
