MINUTES <br />CITY COUNCIL <br />NOVEMBF,R 24, 2004 <br />MORGAN, AND .SUI3.TECT TO REIMBUI2SFMENT OF LEGAL <br />COSTS" I3 P b"HERMAN ASSOCIATES, AND A UTHORIZING TILE <br />PRESIDENI'AND SECRETARY TO Ea'ECDTE THE APPROPRIATE <br />DOCUMENTS ON ]3EFIALF OF TIIE ECONOMIC DEVELOPMENT <br />AUTHORITI' <br />The foregoing resolution was duly seconded by Fahey. <br />Ayes (5) LaValle, Fahey, Montow-, Allan, Blesener. <br />Nays (0). Resolution declared adopted. <br />The City Administrator noted that a utility easement is necessary across a <br />portion of the City's property at Little Canada Road and Middle Street to <br />serve the new 26,000 square foot convnercial building that Sherman <br />Associates will be constructing. The Administrator noted that ultimately <br />the developer will own the property; however, the easement is needed at <br />this time to enable construction of the utility lines that will serve the <br />building. <br />Mr. Montour introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2009-II-9 -APPROVING THE UTILITY <br />EASEMENT AGREEMENT WITII THE VILLAGF, AT LITTI E <br />CANADA L7 C AS PRESENTED, AND A UTHORIZING THE <br />PRESIDENT AND SECRETARY TO Ea'ECUTE THE APPROPRIATE <br />DOCUMENTS ON 13EIIALF OP TILE ECONOMIC DEVELOPMENT <br />A UTHORI %T <br />The foregoing resolution was duly seconded by LaValle. <br />Ayes (5) Montour, LaValle, Fahey, Allan, Iilesencr. <br />Nays (0). Resolution declared adopted. <br />The City Administrator reported that the EDA also needs to act on a <br />Certificate of Completion and Release for The Villas relative to the <br />construction of minimum improvements. <br />Mr. 131esener introduced the following resolution and moved its adoption: <br />RE,S'O7_ UTION NO. 2004-I1-10 -APPROVING TI/E CERTIFICAT E <br />OF COMPLETION AND RELEASL+' RELATIVE TO T HF.
